The guy behind this — Timothy Shea — is THE SAME BARR ALLY who was installed by Barr to run the US Attorney's Office in DC to dismiss the Flynn case.
Now, Barr moved him over to the DEA — AGAIN without Senate confirmation — where he's doing this: 
Which brings us to the EXACT SAME STATEMENT I made about CPB over the weekend:
This proves two things (at least):
1. The US Senate under Mitch McConnell has completely abdicated its constitutional role in advice and consent over executive branch positions.
2. Federal vacancies law must be revised to ensure this sort of action cannot continue.

tl;dr: The same guy, Timothy Shea, who argued that Flynn was railroaded is now putting the full weight of the DEA's authority into domestic surveillance totally outside of its intended investigative authority.
And he never went before the Senate to get confirmed to either job.
