Some comments on @beisgovuk’s answer, concentrating on #stateaid.
Still no details of what the Govt has in mind for a domestic subsidy regime, 6 months before it needs to come into force. (It will need legislation.)
Yes, there are “several complexities”: but that’s an argument for going out and discussing with stakeholders what you should do. Law produced like a rabbit from a hat weeks before it takes effect won’t be good law.
No answer to @LordsEUCom’s questions on enforcement (complaints by those adversely affected by subsidy? Private actions in the courts?)
Or even on whether there is going to be a domestic enforcement authority centred in @CMAgovUK. (If there is, might it now just be worth, er, telling someone, 180 days before it starts work?). See @LordsEUCom’s exasperated question and the stone wall answer.
Though it’s interesting that the EU negotiations are produced as a reason for delay: why so, if the domestic regime is not on the table in those negotiations?
No comment from the Govt on this idea.
Which is similar to mine here. prospectmagazine.co.uk/economics-and-…
But at least no comment isn’t ruling it out.
This passage rather bowdlerises the original @LordsEUCom question.
Which noted (accurately) that “It is troubling that no one we heard from thought that the UK Government had a clear understanding of what state aid provisions it had signed up to in the Protocol”.
No one will change that dim view of the Govt’s understanding of what it agreed to as a result of this hapless answer, which is completely silent about the impact of Article 10 of the Protocol. The silence is deafening.
(This was my evidence to the Committee.)
No response at all to @LordsEUCom’s point that this provision has to be renegotiated. Why? One has to conclude because that would involve accepting the Govt’s mistake in agreeing to it and because the UK would need to make concessions in return. Neither can be admitted.
All in all, unimpressive. @CommonsFREU chaired by @hilarybennmp will need to chase these points down in its current inquiry.
