@billwolflaw @WisenbergSol No, the Constitutional language creates that exception to the use of the power in the first place & only in that one situation. That doesn’t change the fact that if the power is exercised, it can’t be undone.
@billwolflaw @WisenbergSol And in Article 1 it says a person convicted by the Senate in an impeachment trial can still be prosecuted criminally. But if that happened to a President, he would no longer have pardon power so couldn’t pardon himself. /1
@billwolflaw @WisenbergSol There’s definitely an argument from the language that a President CAN pardon himself (& presumably gets promptly impeached.) But either way the argument comes out about the President’s power to pardon himself, it doesn’t change the outcome for anyone else. A pardon is absolute./2
@billwolflaw @WisenbergSol The POTUS is a unique constitutional actor. That the Constitution may prescribe a different result for him personally tells us nothing about the scope of the power as applied to everyone else. There’s no language in the Constitution limiting the pardon power applied to others./3
