Those of you that follow me know I'm deep into political philosophy. I take the time to study political arguments and what their logic is.

Today's DACA ruling is a HUGE blow to conservative philosophy, and I'm going to tell y'all why.

One of the core arguments of modern American conservatives is that only the Congress has the power to make law, which seems reasonable right? They say that by changing regulations The Executive effectively makes laws.

Let me tell you why this is a bad faith argument. Congress, through the lawmaking process, introduced another process for regulatory agencies to change their rules, without Congress itself having to make a new law.

Our Congress recognized that their lawmaking and the debates entailed in that process is SLOW, as the framers designed it to be as a matter of fact. So to counter that, and recognizing that regulations may need to be changed fast Congress created a process of...

...evidence based ways for The Executive to quickly change regulations, and yeah, in essence change laws. Congress WILLINGLY gave this process to The Executive trusting our 3rd branch, The Judiciary, to mediate it.

AND Congress gave us, the citizenry a chance to weigh in through public comments.

As a side note, I'll say this administration's abuse of this process has again reawakened us to the importance of our civic participation.

Also on that note, the irony of the current iteration of the GOP abusing this process so blatantly just show yet again the emptiness of their core arguments. I dont know about you but I'm damn tired of their #SituationalPolitics.

Back to today's ruling. The ruling wasn't that DACA itself is wrong, but that trump's administration, yet again, engaged in specious, non evidence based arguments to try to kill DACA. The immediate effect of this is that DACA will outlast this administration.

But the LONG TERM effect of this ruling is yet another devastating smack down on the conservative idea that an administration can't "make law" by changing regulations. Because the evidentiary requirements are now accepted as a reasonable reason to change a given...

...regulation, AND because the SCOTUS keeps telling this administration they can't just make shit up (think the census loss), we're in a MUCH better place for our future. Most especially given the current push to change law enforcement practices.

So today is a HUGE day for liberal democracy, and gives me hope for a brighter future for ALL of us.

Conservative philosophy and the GOP can suck it. 😂
