Time for a special summer edition of the (nominally) Spring 2020 Unified Regulatory Agenda.

Wherein the Trump administration previews what it really wants to bear down on during its final guaranteed months in office, including immigration policy...

First, a quick primer:

"Proposed rules" haven't even left the starting gate. There is precious little time to get them published, collect public comments, & implement a final rule before Jan 2021.

It's possible, but they're going to have to triage.

If a "final rule" is published by Jan 2021, & a Biden admin takes over, then either:

a) Congress can nullify the rule using the Congressional Review Act (not happening if Rs hold the Senate)

b) Biden admin must do a whole 'nother rulemaking process to rescind a Trump rule

Of course, if Trump wins a 2nd term, his admin will have plenty of time to do everything on this regulatory agenda and more.

But they know that's not guaranteed, so they're going to move as fast as they can to lock in as much as they can this year.

New in this agenda: Now we know that "Security Bars & Processing" means a new "public health" rationale for denying asylum or withholding of removal protections.

This proposed rule was just cleared by OIRA & could be published any day now.

These are just the rules on asylum *at USCIS,* not to mention the CDC rule that has effectively sealed the border against asylum-seekers, based on legally dubious public health grounds.

U visas are hard enough to get as it is, despite the clear benefits for law enforcement & basic safety for victims of horrible crimes (take your pick).

You'd have to be deeply sick & twisted to want to make it even harder.

Also new: Undermining "provisional unlawful presence waivers," which allow undocumented spouses & children of US citizens & permanent residents to apply for green cards in cases of "extreme hardship" (e.g. a really sick spouse or parent).

Other proposed rules USCIS wants to focus on:

Overhauling H-1B visas so you have to earn a top salary to get one. This would be the other shoe to drop after last week's visa ban.

Curiously, the agenda says to expect this in Dec 2020—seems pokey.

Eliminating new work permits for spouses of H-1B workers who already have an approved green card petition (known as H-4 EADs).

Target for proposed rule is Sept 2020—seems too late for a guaranteed final rule by Jan 2021.

Okay, that's *just USCIS.* There's no way they can get all of this rulemaking done in the next 6 months, but the politicals are going to flog their staff all day every day to come close.
