If Trump wins in November, no matter what comes out, the same Rs who would not impeach and remove him will again keep him office - and it will take this same Supreme Court ruling against him for him to be charged with a crime in office.

The opportunity here was to move the process quickly enough to rob Trump of the benefit of hiding his criminality through the election.
