The punishment for armed brigandage

قال تعالى :

Allāh says:

{إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فسادا أن يُقتلوا أو يُصلبوا أو تُقطع أيديهم وأرجلهم من خلاف أو يُنفوا من الأرض..} (المائدة 33)

"The punishment for those who wage war against

Allāh & His Rasūl & strive to create mischief in the land is death or crucifixion or the cutting off their hands & feet from opposite sides or exile from the land..."

قال الشيخ ابن عثيمين:

Shaykh bn al-'Uthaymīn رحمه الله said:

عقوبة قُطَّاع الطريق أربعة أنواع، ولكل نوع جريمة

"There are 4 types of punishment to be inflicted on armed robbers, depending on the gravity of the crime:

قتل وصلب
i. Execution & crucifixion

قتل بلا صلب
ii. Execution only

قطع يد ورجل من خلاف
iii. Cutting off hands & feet from opposite sides

تشريد في الأرض
iv. Banishment

فإذا قَتلوا وأخذوا المال قُتلوا وصُلبوا

i. If they kill & rob, they gave execution & crucifixion.

وإذا قَتلوا ولم يأخذوا المال قُتلوا بلا صلب

ii. If they kill but didn't rob, they face execution only.

وإذا أخذوا المال بلا قتل قُطعت أيديهم وأرجلهم من خلاف
iii. If they rob

only without killing, their limbs are to be cut off from opposite sides.

وإذا لم يأخذوا المال ولم يقتلوا شُرِّدُوا

iv. If they neither killed nor robbed, they are to be exiled.
