Some potentially REALLY really good news in the PP 10052 & 10014 Litigation in DC with respect to #DVLottery Ban: order is unredacting two bullet points that Judge think are going to redressibility. Since standing could be the only sticking point ... fingers crossed.

Why is this relevant you ask? Well, for starters it shows what we all have known for a long, long, very long time: DOS and DHS lie and have lied once again.

Reopening of consulates was never intended to be tied to local conditions

But this little tidbit is particul important to #2020DV applicants who are fighting to keep '20 Diversity Lottery program going is that it shows that if Court orders DOS to process they before 9-30-20 they CAN DO IT right then &there and can't bitch abt local conditions.

So yes! judge Mehta hit it on the noggin when he ruled that this is relevant to whether he can grant relief to DV applicants.

Yes he can, ergo Govt standing argument goes bye-bye!

But the slide with the remaining CAR also supports the Plaintiffs' argument that there is a 'final agency action' which Govt is always using to nix APA claims. Here, we have a nice breadcrumb for the judge to say yep! APA claim is viable as to all DV applicants in FY2020 coz

... remember we already have a cable that says consulates are to decide whether to schedule emergency interviews for 'national interest waivers" (which they added to moot and defeat pending lit) but now we know that the final action is simply suspending FY2020 -- nothing left

for consulate to do! the agency but leaving it only to DOS to approve reopening has consummated all decision making that it purportedly had given to consulates.

If judge finds standing **and** final agency action then all DV applicants win. Govt has nada!

So yes! this is huge but will see how the Court will sees it. Standing for some of the DV applicants is and remains my biggest concern.
