Under “Mandatory exclusion” HHS is required by law to remove any entity *convicted* of certain federal crimes, like trafficking of human body parts, Medicaid fraud, & patient abuse.

Under “Permissive Exclusion” HHS has the authority to exclude orgs based on misdemeanors, fraud, professional misconduct, or for providing “unnecessary or substandard services.”

The President (through Executive Order) or @SecAzar (through his authority as head of HHS) has authority to exclude Planned Parenthood from Medicaid.
