Even if we could find all 545 parents, it doesn’t mean they would be reunified. @AlOtroLado_Org represents almost all parents deported without their kids and they have almost no rights under the Ms L settlement. The govt has done everything possible to keep them apart
Also, it’s no surprise we can’t find these parents. 2017 separations weren’t included in the initial Ms L class, despite on the ground advocates begging for them to be included. @JusticeInMotion wasn’t tasked with looking for them until 2019! Of course it’s hard
Our @JusticeInMotion @AlOtroLado_Org team is working with 25 deported parents who are suffering immensely after years of separation. The court/govt STILL hasn’t established a clear reunification process and we have to fight like hell to even get the court to consider these cases
It’s infuriating how much easier it has been to bring back deported folks under other litigation, yet the govt/court acts like it’s impossible in cases of brutal family separation. We’ve put forth relatively few cases for reunification in the US, approving them should be easy!

If you are mad about #FamilySeparation then you need to stand against expanded expedited removal, which lets ICE snatch immigrants from our communities and deport them with zero due process. Guarantee that many kids will lose their parents to this policy
Expanded expedited removal makes ICE the prosecutor, judge, and executioner. It’s like having the police officer who arrested you find you guilty without a judge or defense atty. It’s incredibly dangerous for immigrants and citizens alike
There have been MANY cases of US citizens detained by ICE/CBP. In my experience, I had to bring proof of citizenship before a judge to win release. Expanded expedited removal takes the judge out of the process, so expect to see more US citizens dumped over the border

After having seen half a dozen caravans come through Tijuana prior to 11/2018, I believe that caravan was, in part, orchestrated to affect the US elections and increase repression against migrants and the attorneys and others who offer assistance
Caravans prior to 11/2018 were much smaller and more focused on protecting the most vulnerable travelers (women & kids). 11/2018 was DIFFERENT. It was the first time I felt unsafe offering basic legal information to the migrants. They had been told that the lawyers were lying...

As anticipated, McAleenan’s planned remarks were BS so we didn’t miss anything. However, this point particularly irked me...it’s NOT a good thing that Mexico has deployed the national guard to its borders. Living on an insanely militarized border is a daily exercise in terror
In my daily work, I pass through several militarized checkpoints, staffed by masked soldiers holding high-caliber assault rifles who can arbitrarily decide to search or detain you. There is no due process if you are stopped and I’m not even sure where you would be taken
My neighbor is American, he just moved here with his Mexican wife & kids and doesn’t speak much Spanish. Two nights ago, he was out riding his bike when he was surrounded by military and national guard soldiers. They took him off his bike and tried to shove him in their truck

Thanks for everyone who showed support for my bond hearing to free our disabled client at Otay Mesa. I want to give an update, but the detained docket was so wild that I’m going to take my inspiration from @ScottHech and drop a THREAD:
First up, the judge had to conflict out of a review of a negative reasonable fear finding. She had been an ICE trial attorney for over a decade, and had helped deport the man who had returned to the border to seek protection. MOST judges I know used to work for DHS or were AUSAs
...which means the judge often acts as a prosecutor, which was definitely the case today. Next up on the docket was a young man who had lived in the US for 7 years and has a US citizen baby. He has no criminal record, a university education and good employment history.

I’m in #Calexico working with 17 parents who were separated from their kids and deported without them. These 17 parents were among the 29 who returned to the US on 3/2 to reunify with their children and seek asylum. They are STILL detained
They are all STILL separated from their children. ICE won’t consider their release until they pass their Credible Fear Interviews, yet Asylum HQ ordered that they NOT schedule the interviews for weeks! We had to ask members of Congress to intervene
It’s heartbreaking to see how traumatized the parents are from this detention and continued separation. I felt like I was torturing them by making them talk about why they fled their countries. One of the dads was pulling his beard out and crying as we prepared for his interview
