If your purpose is going to six abodes of Lord Murugan, why do you want to tour through routes where there are no Murugan temples at all, Justice M. Sathyanarayanan asks BJP counsel V. Raghavachari @THChennai
How many people are going to accompany you? How many vehicles will ply? How many above 60 years of age will be there? These are the particulars we require, says judge.
We can take cognisance of newspaper reports and photos of the number of vehicles that participated in the Yatra yesterday, adds judge.
Central Government notification permitting religious congregations is only directory and not mandatory: judge
Being a State president of a national political party, don't forget the fact that apart from COVID-19, revenue and police will now have to deal with monsoon also: Judge
Advocate Raghavachari: We'll not exceed 100 people when going to temples.
Judge: Then, give a new representation to DGP.
Advocate General Vijay Narayan: BJP has not challenged rejection order passed by Tiruvallur Superintendent of Police.
AG : Yesterday many were not wearing masks. I can show video.
AG: BJP counsel is oversimplifying matters by saying Party president wants to visit temples and we are preventing him. It's not like that. He wants to have a huge gathering with him.
BJP counsel: My client will use 15 cars & he will be accompanied by 30 persons alone.
Judge: Don't forget the fact that you cannot choose your own route. There are shorter routes available. L&O and public order is also involved.
Judge: You should have some responsibility
Justice M. Sathyanarayanan reads out judgement passed by Justice Sanjay Kishan Kaul of Supreme Court in anti CAA protest Shaheen Bagh case on October 7.
Judge: You are not just congegating in temples but also going on a procession across the State.
Judge: Give a fresh representation with all particulars, let the police take a call.
Judge: Unfortunately in this country, courts are used to settle political scores. We'll not let that happen.
When Tasmac is open, temples are open, how can going with 30 people will risk lives?
Judge: Only now you are saying about 30 people
BJP ADV: Then, let me be given time till Monday to get instructions on making a fresh representation.
Judge: Let it be on Tuesday
Judge: Make fresh representation disclosing how many vehicles, how many persons are going to accompany you.
Adv: Yes My Lord
BJP lawyer: Let police grant permission with conditions. We will not breach even one condition.
BJP lawyer: If it's going to be 30 persons and 15 cars, what objection can police have?
Judge: I don't know. Police have to decide. What if overenthusiastic cadres come in large numbers to receive the party president?
Judge: Yatra will end on Dec 6? Babri Masjid demolition day?
BJP lawyer: Everybody will forget it as a bad day because Ram Mandir is going to come. Even otherwise, we will restrict Yatra to Dec 5.
Justice R. Hemalatha, the other judge in the Division Bench, wonders why Govt is opposing Vetri Vel Yatra when thousands of devotees are allowed to congregate in temples.
Case may get adjourned to Tuesday
