Follow live coverage of failed GOP candidate Jim Marchant's longshot bid for an election re-do after getting pummeled by ~5 points and +10K votes at the ballot.
Marchant stumbles out the gate, @ZoeTillman observes below in her live-tweet.
Mary Anne Miller, repping Clark County Clerk Joe Gloria, slams failed GOP candidate Jim Marchant's lawyer for his opening rant.
"Mr. [Craig] Mueller said some extraordinary things, and they're all completely baseless," Miller says, adding he got facts of voting machines wrong.
DNC's attorney Kevin Hamilton is now up.
"It's not like Clark County in the United States that uses the Agilis machine."
It's used across the country, and a challenge against it has been rejected before, he notes.
Hamilton:
The failed GOP candidate-plaintiff would need to show +16,000 illegal votes, but he can't do that.
Hamilton's incantation:
The failed GOP candidate-plaintiff would need to show illegal ballots were cast.
"He fails at that."
He would need show show for whom they were cast.
"He fails at that."
And enough to change the result.
"He fails at that."
Hamilton:
The failed GOP candidate-plaintiff cobbled together "back of the napkin" clippings in support of his case.
The failed GOP candidate-plaintiff's counsel Craig Mueller says what happened in Clark County would have gotten someone "into prison."
He doesn't elaborate on that claim.
Judge Gloria Sturman talks about the lawsuit's strange request for a one-county re-do:
"This is a huge part of our state, and because of some alleged counties in Clark County, only Clark County" would have a re-do the failed GOP candidate is requesting.
"Nobody was denied their right to vote," Judge Sturman observes, noting it has not even been alleged.
Judge Sturman notes that another problem for the plaintiff is the math.
"That's my problem here. We would be looking for— to make up a difference of 30,000 votes, and I just don't see how."
Flailing in court today, the plaintiff's attorney Craig Mueller asks for another hearing on Monday to review the data of computer backup logs.
Counsel for Clark County Joe Gloria replies: "I don't know what he's talking about."
Mueller didnt explain the data he wants.
Clark County Clerk Gloria's counsel Mary Anne Miller:
"In the general election, inactive voters were not sent mail ballots."
She reiterates the losing candidate's counsel hasn't explained what data he wants, and she can't get it this weekend.
DNC's counsel Kevin Hamilton:
"This court does not have jurisdiction over this matter and should not exercise any jurisdiction over what is essentially a public records request."
Judge Gloria Sturman appears to agree she lacks jurisdiction for a single Clark County re-do the failed candidate requested: "We are leaving out 6 other counties in an election for a congressional seat. I don't see how I can do that.
"I just don't feel like I have jurisdiction."
DENIED by Judge Sturman for lack of jurisdiction.

Despite every baseless fraud allegation collapsing in Michigan's federal and state courts, @MIGOPChair and @GOP want to delay certification scheduled for Monday for 14 days based on claims they cannot prove before judges.
In a federal case in Michigan, the Trump campaign withdrew their claims and then lied about the reason in a court filing. lawandcrime.com/2020-election/…

"It's time to dial back the rhetoric, conspiracies and false claims. In a free democracy, elections result in some people's candidate losing... I'm not going to violate the law or deviate from my own more compass."

"I have not played games with any other canvass we have voted we have voted on over the past eight years of sitting in this chair and as sitting on this board. I am not calculating or playing games today."
— Maricopa County Supervisor @Steve_Chucri (R), certifying the election
JUDGE: "In other words, Plaintiffs ask this Court to disenfranchise almost seven million voters. This Court has been unable to find any case in which a plaintiff has sought such a drastic remedy in the contest of an election."
That outcome would require "compelling legal arguments and factual proof."
"I was inspired by my grandfather who was a World War II vet. He went to Europe to fight for democracy."
