A few thoughts on last night's Proud Boys conspiracy charges having now read the indictment. 1. The govt alleges at least for now a conspiracy that lasted only 1 day. Perhaps they'll supersede w/more info. But at present, they're not accusing the defendants of much preplanning.
That said, govt is alleging the two defendants, Dominic Pezzola & William Pepe, conspired w/others "known & unknown to the grand jury," which means 1. There's a grand jury (apparently) still investigating and 2. There could easily be more charges on this indictment.
Here the govt seems to suggest that Pezzola & Pepe were part of the 100ish strong gang of PBs that mustered in DC on Jan. 6 & marched on the Capitol under the leadership of Joe Biggs. Biggs has been charged in a separate case on a complaint. Will the two cases merge?
Conspiracy law is a pretty broad tool but the indictment doesn't offer much in the way of Pezzola & Pepe actually acting in concert. Here, for instance, they are said to have "walked in close proximity" in the Proud Boy mob.
The feds clearly say here that Pezzola stole the riot shield he used to smash a Capitol window from a cop.

Pezzola, a former Marine from Rochester, can be seen in photos w/Pepe, an employee of New York City's Metropolitan Transit Authority.
This is first conspiracy indictment related to the Proud Boys. In other Proud Boys court papers, prosecutors hinted at a conspiracy, noting that Pezzola, one of the first rioters to breach the Capitol, was wearing an earpiece for comms.
The FBI says Eric Chase Torrens, seen left in the fleece hat, illegally entered the Capitol w/his friends from Tennessee, Matthew Bledsoe & Jack J. Griffith. Bledsoe & Griffith were charged last week.
The FBI arrested Justin McAuliffe, 39, of Long Island, after he posted a Facebook photo of his cellphone set to the Senate's public WiFi network.
Prosecutors are now saying that Michael Foy, a Michigan man arrested for assaulting police officers at the Capitol with a hockey stick, beat at least 10 cops, including some who were downed, also threw a sharpened pole at them.
According to new court papers, Foy, a former Marine trained in combat, engaged in some of the most violent conduct at the Capitol riot.
Overnight, prosecutors in Tennessee released a detention letter in the case of Eric Munchel, aka Zip Tie guy.
Munchel went to the Capitol armed w/only a Taser but this is the arsenal agents later found inside his house: assault rifles, a sniper rifle, shotguns & pistols.
Munchel seems to have found the zip ties inside in the Capitol itself, lying on a table in a hallway.
According to a video obtained by the FBI, he picked them up.
"Zipties," he says. "I need to get me some of them motherfuckers."
Next up in the courtroom in DC is Josiah Colt, of Boise, Idaho, the Senate chamber dangler.
Answering questions about whether he is eligible for appointed counsel, Colt is asked how much money he has in the bank right now.
"Negative $463," he says.
Robert Sanford, the retired PA firefighter who has been charged in the DC riot, went to the Capitol following "the President's instructions," a complaining witness told the FBI.
Peter Harding, a Buffalo area man, has been charged by feds in the Capitol riot. The FBI notes that he was captured in social media photo lighting fire to media camera equipment outside building before entering.
The FBI says Kevin Lyons was "evasive" at first about being inside the Capitol. Then, when agents showed him an Instagram pic he'd taken & posted of Nancy Pelosi's office, he caved.
"Wow, you're pretty good," he said. "That was only up for an hour."
