New: Chief Judge Howell just overturned a magistrate judge’s decision to keep Couy Griffin, the Cowboys For Trump guy, in jail pending trial. She said his actions are “troubling” and “unpatriotic,” but he didn’t enter the Capitol itself and doesn’t pose a flight risk, she said.
His lawyers tried to argue that even having a detainment hearing b/c of public statements Griffin made (including saying that "there’s gonna be blood running out" of the Capitol) was a violation of the 1st amendment. The judge denied that argument, but ruled to free him.
Griffin clearly dislikes (“to put it mildly,” the judge added) Congress and the executive branch, but “he hasn’t expressed such a disdain for the judiciary court orders," suggesting he isn’t a flight risk and would show up for his future court dates, she said.
“There’s gonna be blood running out of that building. But at the end of the day, you mark my word, we will plant our flag on the desk of Nancy Pelosi and Chuck Schumer and Donald J. Trump if it boils down to it.” Days before the inauguration, Griffin was arrested near the Capitol
Due to delays in the court system because of Covid, the judge said that Griffin could wait a year before his trial, and what he is charged with only carries a year sentence if he's found guilty. Also, he refuses to wear a mask, which could delay his trial further.
“It might be a form of rough justice for people who don't want to wear masks contributing to the spread of the virus, sitting in jail, in pretrial detention,” Judge Howell said. “But on the other hand, shouldn't the court be concerned about the fairness of that kind of result?”

Listening to this now, (it's hard to hear) Chansley's lawyer said that, citing Wikipedia, a part of religious shamanism is "communing with other spirits and other parts of nature" through the consumption of organic food, and preservatives and other chemicals interrupt that.
The government lawyer says "the defendant has not established that an exclusively organic diet is an exercise of his shamanism, even if it is DC’s legitimate food service the administrative hurdles to provide him an exclusively organic diet outweighs a religious diet"
Chansley's lawyer says he has refused to eat food for "9 plus days now," and that the gov wouldn't be able to find in their research that eating organic is a tenant of their religion b/c "one of the fundamental tenants of shamanism is the absence of fundamental tenants"
In the hearing for Riley June Williams, the 22 y/o accused of stealing (or helping to steal) Nancy Pelosi's laptop and sell it to a contact in Russia, her lawyer says that she is charged w aiding and abetting the theft and that a search found she doesn't have the computer....
The gov lawyer is being tight-lipped because she is concerned that giving too many details about the investigation could jeopardize it, but she says that Riley Williams deleted her accounts *before* she turned herself in, and instructed others to delete evidence.
Williams' lawyer says that the majority of the accusation made to the FBI about her stealing Pelosi's computer & trying to sell it to Russia were made by an ex who "vowed to bring revenge on her" and who Williams is getting a restraining order against. ...
I am listening in on the arraignment of dozens of people who were arrested at the pro-Trump riots and protests at the Capitol yesterday. Will tweet what I find out.
The first person arraigned in connection with yesterday's riots is Michael Amos from FL. Charges: Unlawful entry to the capitol building & violation of curfew. The Judge says he disobeyed Capitol Police & Metropolitan Police Dept. He is released pending trial, but banned from DC.
He was held overnight. He said his phone is dead, and that he's staying in a hotel outside of the DC area and that he has to drive through DC to go home to Florida. The government agrees to allow him to drive through the city if he doesn't get out of the car. He has no priors.
Watching the C-Span feed for the House vote, which resumed for only a few minutes before staff entered the chamber making motions for the members to sit down or get down. C-Span is now showing protestors walking through statuary hall.
Statuary hall separates the House and the Senate. They are mostly slowly walking between the velvet ropes as someone chants "this way! this way!"
Between the two recesses for security, Rep. Gosar gave a quick and nervous-sounding speech that was cut short. He was visibly sweating. A pool report says that lawmakers were told to shelter under their chairs in the House chamber.
Just out of a hearing in the NY Parnas & Fruman case. The gist was that the team for Fruman (who is not complying w the congressional subpoena for impeachment) is pissed that Parnas handed over A LOT of info to Congress without screening for Fruman’s attorney-client privilege.
The issues at hand were pretty technical, but there was a lot of tension between Fruman & Parnas’ lawyers. Also, Parnas’ lawyer randomly brought up that’s thinks AG Barr should recuse himself from the US V. Parnas case. No one else in the court wanted to touch that w a 10 ft pole
Neither Parnas nor Fruman were there, just the lawyers. They have another hearing scheduled for Monday and when the judge asked all the lawyers if their clients wanted to show up, everyone said no except Parnas’ who said “You couldn’t keep him away.” Everyone laughed.
The gov has seized *a lot* of Parnas' devices. The list they gave: 6 devices at the time of arrest, including a Samsung device, iPad, 2 iPhones, cell phone. Then 8 more from his house: 3 more iPhones, Samsung galaxy phone, iMac, and iPad (no phone in court, may have missed 1)

The gov lawyers said that they haven't been able to get into any of the encrypted devices, and that FBI has been working overtime to get into them. Said if Parnas provides them the passwords it will speed up the process and they will be able to get the devices to Congress faster.
