BREAKING: Judge James Chalfant has issued a preliminary injunction against Los Angeles D.A. George Gascon that will restrict him from refusing to prosecute CA's three strikes law and will restrict him from dismissing special circumstance allegations without legal grounds. @FOXLA
Judge Chalfant: "The District Attorney's disregard of the Three Strikes law "plead and prove" requirement is unlawful, as is requiring deputy DA's to seek dismissal of pending sentencing enhancements without a lawful basis."
This is a major win for @LACountyADDA vs Gascon @FOXLA
Here is Judge Chalfant's official ruling/conclusion. I've reached out to George Gascon's office for comment. Will update if/when I hear back. @FOXLA
More from Judge Chalfant: "[Gascon's] special directives require prosecutors to violate California law, their oaths of office, and their ethical and professional obligations.
Judge also says the statement Gascon orders them to read in court is legally inaccurate/unethical. @FOXLA
Expect Gascon to appeal this or ask for a stay of the injunction. Ultimately, this will likely end up in a higher court, but for the moment, it is a legal rebuke to some of Gascon's special directives which he has asserted are lawful. Judge says no, they're not. Stay tuned...
NEW: L.A. DA George Gascon has released the following statement in response to a judge’s ruling against him today. He says he is reforming a dated institution “steeped in systemic racism” and says he will be appealing the decision. @FOXLA

Listening in on L.A. D.A. union lawsuit vs George Gascon hearing.
Judge just asked Gascon attorneys if Gascon is abandoning the three strikes law. They say no, he's not.
Judge says so he won't enforce it, but you won't call that abandoning it?
Attorney calls it "semantics".
Gascon's attorneys are currently arguing that the D.A. union doesn't have standing to sue Gascon.
Judge just asked Gascon attorneys if they believe CA's three strikes law is unconstitutional.
"No", they reply.
But here's what Gascon said in his directive.
"It is the position of this office that Penal Code section
1170.12(d)(2) and Penal Code 667(f)(1) are unconstitutional."

NEW: Outdoor dining has reopened in L.A. County as of today, but now the Health Department is banning restaurants from having their TVs turned on for customers. @FOXLA
Directly from the new health order: “Televisions or any other screens that are used to broadcast programming must be removed from the area or turned off. This provision is effective until further notice.”
It’s obvious the Health Department wants to stop people from watching the Super Bowl outdoors at sports bars/restaurants, so they are now going to force people to watch it indoors with private home gatherings by taking the outdoor option away. Absolutely brilliant 🙄

BREAKING: This mudflow that happened in front of us in Silverado Canyon is beginning to swallow up the front of a home. We’re told the residents evacuated. Sheriffs Department now on scene. @FOXLA
Multiple mudslides. Another one just happened in front of us again. @FOXLA
We are currently trapped, but perfectly fine. Roads are impassible from multiple mudflows. Bulldozers on scene trying to clear it. Residents out in streets concerned about stability of other hills near their homes. @FOXLA

BREAKING: We just had a minor mudslide in front of us in Silverado Canyon. @FOXLA
Some smaller cars having to turn around. Rain and flooding getting worse. This small debris flow only happened with about 45 minutes of light/moderate rain @FOXLA

TONIGHT 1/3: Under D.A. George Gascon's reforms, special charges are not being filed against either suspect in the high profile cases of two decapitated children, and two LASD deputies who were shot in ambush, meaning both would be eligible for elderly parole after 20 yrs @FOXLA
LASD Deputy Claudia Apolinar, who was shot in the face, tells me she is outraged about Gascon's new directives. Gascon's office will seek to dismiss gun enhancements w/ great bodily injury against Deonte Murray, accused of shooting them.
Apolinar texted me this statement. @FOXLA
Veteran @LASDHQ homicide detective is handling both cases. He is also outraged. He says Gascon's reforms stopped special circumstances of multiple murders from being filed in case of father who allegedly decapitated his kids with an axe.

BREAKING: In rebuke to D.A. George Gascon's reforms, judge has DENIED motion to drop all gun enhancements & special circumstances against Rhett Nelson, man charged with murdering LASD deputy Joseph Solano & skateboarder Dmitry Koltsov. Nelson had an outburst after ruling. @FOXLA ImageImageImage
Deputy Solano's sister, son, and gf tell me they are relieved by the ruling and feel this is the first step towards getting justice. If the judge had agreed to drop the special charges, Nelson could have gotten a parole hearing at age 50. Now he faces life w/out parole @FOXLA
A deputy DA from San Diego was also at the hearing this morning, and accused Gascon of being dishonest when claiming that defendants are facing 50+ years in prison even without special charges. He says with California's elderly parole law, that's not true. @FOXLA
