Capitol insurrection defendant Dominic Pezzola, who was charged in one of the Proud Boys conspiracy cases, is challenging an order keeping him in pretrial detention. A few things of note:
- His lawyer is in touch with the feds about a potential plea deal assets.documentcloud.org/documents/2048…
- Pezzola's lawyer strongly suggests ("it is believed") that there's a Proud Boys member "much more active" in the org than Pezzola who has already cut some sort of deal with the feds and is cooperating
- This is another entry in the category of Capitol insurrection defendants shifting blame to Trump/others who pushed the lie of widespread voter fraud: "..having time to reflect and see how things have revealed themselves, he now realizes he was duped into these mistaken beliefs"

Yesterday, a federal judge in DC ordered detention for Eric Munchel (photog'd in tactical gear with plastic handcuffs) and Lisa Eisenhart (co-defendant and Munchel's mother): buzzfeednews.com/article/zoetil…

Update: Eric Munchel (the guy photographed in the Capitol holding zip tie handcuffs) is now also appealing yesterday's order keeping him in jail pending trial.

This is the first ruling on pretrial detention for Capitol insurrection defendants to head up to the DC Circuit — given that there are ongoing detention fights and more prosecutions to come, any DC Circuit precedent on how judges should be analyzing this could be a big deal

A federal judge in DC is holding a detention hearing in the cases of Capitol insurrection defendants Eric Munchel (who was photographed wearing tactical gear and holding a bunch of zip tie handcuffs) and his mother Lisa Eisenhart — the govt is arguing to keep both behind bars
Re: the zip tie handcuffs that Munchel and Eisenhart allegedly picked up inside the Capitol, AUSA Ahmed Baset says they were visible to lots of people passing by at the time but these two not only took them, but did so "with glee"
Baset says it's true that Munchel and Eisenhart aren't charged with physically hurting anyone, the evidence shows they were looking for lawmakers, who had been cleared out. "They should not be given credit for that," Baset argues.

Today, DOJ filed a motion to dismiss claims against eight Park Police officers who are defendants, arguing they cannot be liable for carrying out "a high-level policy decision" and that there's no evidence they personally interacted with the plaintiffs: assets.documentcloud.org/documents/2048…
Motions to dismiss have been trickling in from different categories of defendants since the fall; the judge hasn't ruled yet. Trump/Barr/Esper filed back in Oct. arguing the plaintiffs lack standing and, regardless, they're shielded by sovereign immunity:  assets.documentcloud.org/documents/2048…

Newly unsealed: A grand jury returned an updated indictment against Douglas Jensen, the Capitol insurrection defendant identified in videos chasing Officer Eugene Goodman — adding an obstruction count + weapons enhancements assets.documentcloud.org/documents/2048…
A judge will hear arguments on 2/23 on the govt's motion to keep Jensen in pretrial detention (an Iowa judge had approved release) — the govt noted that Jensen was allegedly carrying a knife in docs arguing for detention, so the new indictment now reflects that
