Jushawn Brown, the man who was driving the car in which 21-month-old Kayden Swann was riding when the boy was shot during a road rage conflicted on LSD this week, is on deck in bond court....
...Police allegedly found him in possession of a firearm at Northwestern Memorial Hospital where Kayden was initially taken. CWB reported today that police say they found the gun after Brown's girlfriend (Kayden's grandma) told cops he was carrying...
...Here we go. He's charged with one count of unlawful use of a weapon. That's a felony...
...Prosecutor: Brown was driving when and SUV almost struck his car on LSD. Words were exchanged. SUV driver pulled a gun and asked what he's going to do about it. Brown took his gun out and put it on his lap...
.....Prosecutor: The SUV driver fired shots at the car and one bullet came through the rear window and hit the boy in his head. Police approached him about a possible gun at the hospital...
.....Prosecutor: Police asked if he had anything he shouldn't and Brown replied "I have my protection." Cops patted him down and retrieved the gun. He has no felony convictions...
.....Judge Charles Beach notes that Brown appears emotional and offers a break. Brown says it's OK to continue...
...Defense: He's a machine operator, has two kids, lives with his girlfriend. Requests an I-Bond. Says there is no indication that Brown fired his gun. All casings come back to a different weapon...
...Judge Beach: "I wish the best for you and your family and your grandchild. I cannot imagine anything worse than what you are experiencing."
A couple of important notes here:
1) CPD issued a statement saying Brown was charged with unlawful use of a weapon by a felon. In fact, he is not a felon and is not so charged.
2) The CPD statement said Brown fired shots at the other vehicle. Now, there’s no evidence of that.
...Beach: There is no evidence that Brown was antagonistic and there is no evidence that the other driver knew he was armed. Brown has minimal background.
But, monetary bail is necessary, judge says...
...Beach: $5,000 bond. $500 to get out.
...And, as an aside, Kayden is now said to be 22-months-old after previously being said to be 21-months-old, 1-year-old, 2-years-old, and 3-years-old.
