In March, @NLIHC wrote to @SecYellen @SecFudge @AmbassadorRice @genebsperling to share emerging & troubling trends with ERA programs & urged quick improvements to ensure the $ reaches the lowest income people in need. They listened and quickly acted.
Only a small # of ERA programs are using direct-to-tenant assistance despite some landlords refusing to participate.

We urged Treasury to strongly encourage direct-to-tenant assistance & reduce time period to determine landlord refusal.
❗️Treasury and WH responded by cutting time to determine landlord refusal in HALF (5 days) and REQUIRING direct-to-tenant assistance when landlords refuse to participate❗️
Treasury and the WH also state that “starting w/today’s guidance,” ERA programs must PROHIBIT the eviction of renters for nonpayment in months for which they receive ERA.
Despite flexibility to use self-attestation for most eligibility criteria, many ERA programs are still imposing burdensome documentation requirements.

We urged Treasury to make clear that self-attestation is allowed and preferred.
❗️Treasury & WH responded by PROHIBITING grantees from establishing burdensome documentation requirements, noting that such documentation requirements “pose significant barriers to participation for eligible households.” ❗️
Some ERA programs are explicitly excluding subsidized renters - some of the lowest income people most at risk of homelessness - from receiving needed assistance.

We urged Treasury to ensure that subsidized tenants get ERA when needed.
❗️Treasury and WH responded by PROHIBITING programs from denying ERA to federally assisted renters, noting that doing so could violate Title VI of the Civil Rights Act ❗️
While renters with income up to 80% of AMI are eligible for ERA, the law requires that programs “prioritize” very low-income households at 50% or below AMI.

We urged Treasury to better define and encourage prioritization.
Treasury and WH responded by REQUIRING programs to “ensure that assistance is reaching those who need it most” by reporting on how they will prioritize assistance.
While some of these improvements apply specifically to 2nd allocation of $, WH & Treasury make *very clear* what they consider model ERA programs that serve lowest income renters. It’s clearly best for administrators to apply this guidance to full ERA program

Several district courts have attempted to strike down moratorium, but all had limited application. There are now numerous conflicting court rulings at the district court level, with several judges ruling in favor of the moratorium and several ruling against.
While this latest ruling is written more starkly than previous ones, it likely has equally limited application impacting only the plaintiffs who brought the case or, at most, renters in the district court’s jurisdiction.

🚨Tonight, a federal district court judge in TX ruled the CDC eviction moratorium unconstitutional.

Renters, don’t panic: THE MORATORIUM IS STILL IN EFFECT. The judge did NOT issue an injunction.

But he may in near future. The CDC must appeal immediately.
While this ruling could put millions of struggling renters at risk of losing their homes during the pandemic, it’s important to know that two other federal district courts have previously UPHELD the eviction moratorium.
But the TX judge invites landlords that brought the case to request an injunction if feds don’t abide by his ruling. A nat’l injunction would have disastrous effect, putting tens of millions of people at immediate risk of homelessness during the pandemic.

Here’s more info on the emergency rental assistance included in Covid relief package. (thread)

$25 billion for emergency rental assistance would be funded through the Coronavirus Relief Fund (CRF) and administered by the U.S. Department of the Treasury.
Of $25B total, $400 million would be allocated to U.S. territories and $800 million to tribal communities. The remaining funds would be distributed to states and cities with populations of 200,000 or more. Each state would receive a minimum of $200 million.
At least 90% of the $ must be used to provide financial assistance, including back and forward rent and utility payments, and other housing expenses. Assistance can be provided for 12 months, or up to 15mo if needed to ensure housing stability for household.

Today Congress votes on bill with immediate & essential relief for millions of struggling renters, preventing tens of millions from losing their homes next month. The bill extends the eviction moratorium through 1/31 & provides $25B in rental assistance. 1/
While extending the CDC eviction moratorium for just 1 month is clearly insufficient to keep people housed for duration of pandemic, the extension provides essential & immediate protection for millions of renters on the verge of losing their homes in weeks.
Extending the moratorium through January provides time for some emergency rental assistance to be distributed, and for President-elect @JoeBiden to strength and further extend the moratorium immediately after being sworn into office.
