THREAD: Brad Bennett of North Carolina has just filed new request to be released from jail
His case is interesting
He's accused of posting on Facebook: “FAIR WARNING. IF THIS ELECTION IS STOLEN FOR BIDEN, PATRIOTS WILL GO TO WAR.”
But there's also what happened *after* Jan 6
Feds allege Bennett went dark as they searched for him.
He was "laying low", advised others he couldn't use phone and didn't surrender for 12 days after agents notified him of arrest warrant, per feds
Oh.. and federal agents say Bennett instructed close associates to shift to "TELEGRAM" for encryption and threw a $1000 phone out of the window on the way to the courthouse
Feds say Bennett was inside the US Senate chamber on Jan 6.... one of the charges he faces is a felony.
They say he has a "disregard" for the law and complying with it
To secure his release from jail, Bennett is offering to be confined in home detention, with an ankle monitor and a 3rd party custodian to monitor him

ALERT: Judge Tanya Chutkan has just allowed the unsealing of approx. 1900 pages of Jack Smith records in the Trump 2020 election conspiracy case.
Heavy, heavy redactions. Lots to go through.
But note that the records include Mike Pence's announcement on Jan 6, 2021 that he would not overturn results
The first batch (720+) pages includes heavy redactions, but also has transcripts of depositions/interviews between Trump aides/allies and the House Jan 6 Select Committee.. including questions about the "substitute" batches of electoral votes
NOW: Justice Dept asks for 27 months prison in Jan 6 case of Dana Bell, arguing “history cannot repeat itself” after the 2024 elections. Prosecutor tells judge “deterrence” is critical
Bell is accused being “agitated, angry & violent” as she accosted police & media on Jan 6
Prosecutor argues Bell engaged in “prolonged, abusive and violent” behavior. Prosecutor says Bell grabbed police officer’s baton, as police tried to clear mob away after Ashli Babbitt was shot
Prosecutor says Bell uncorked a “verbal barrage” toward officer Jeff Smith, who died days later by suicide
Prosecutor says Bell is heard telling Smith “get a real job”, “no one supports you”
IN COURT JUST NOW: Justice Dept prosecutor tells judge that the Bureau of Prisons "confirmed there was an error" ... mistakenly releasing Jan 6 defendant Leo Kelly from its prison facility in Rochester, MN
Leo Kelly was sentenced to 30 months prison in August 2023, accused of breaching the Parliamentarian's office while amid the mob.. and of facing off against "an outnumbered line of officers"
Prosecutors say prison bureau "misread" or miscalucuated filing about Kelly prison term
Leo Kelly appeared for the court hearing by zoom.. and he's asked the court to allow him to remain free (on release conditions) pending a "re-sentencing hearing"
Prosecutors want Kelly remanded back to the Bureau of Prisons pending re-sentencing hearing
The Justice Dept says the FBI located a semiautomatic rifle w/ scope near where Routh was hiding near Trump golf course
Feds: "The rifle was loaded with a total of 11 rounds and had a round in the chamber. The serial number on the rifle was obliterated and unreadable"
Justice Dept court filing includes image of gun. And a backpack containing plates capable of "stopping small arms fire"
Feds say when police stopped Routh in his Nissan last Sunday, the car had false license plates & "FBI agents found 2 additional license plates. The agents also found 6 cellphones. One of the cell phones contained a Google search of how to travel from Palm Beach County to Mexico"
Justice Department says it WILL seek pretrial detention in the new criminal case of Sean "Diddy" Combs
Justice Dept filing seeking court order to jail Sean Combs:
"The defendant poses an ongoing and significant danger to the community, has repeatedly engaged in obstructive conduct, and presents a serious risk of flight. The government respectfully submits that the defendant cannot meet his burden of overcoming the statutory presumption in favor of detention. There are no conditions of bail that would assure the appearance and compliance of the defendant, or the safety of others. Accordingly, any application for bail should be denied"
Justice Department (More) in its request for pretrial jail for Sean Puffy Combs:
"The incentive to flee is especially strong for this defendant, who, at age 54, faces the very real prospect of spending a substantial portion of the rest of his life in prison"
