Jackson writes Trump isn't helping his supporters stay out of jail by continuing to "propagate the lie that inspired the attack" — and she calls out unnamed media outlets and party leaders "intent on censuring those who dare to challenge the former President’s version of events"

Status hearing in the case of Jan. 6 defs Jenny Cudd and Eliel Rosa offers insight into how plea talks are unfolding in these cases: Prosecutor says govt made informal plea offer as to the felony obstruction count, Cudd asked for deferred prosecution agreement and govt said no
A deferred prosecution agreement (DPA) would basically mean that charges against Cudd would be dropped assuming she fulfills certain conditions. The AUSA told the court that was not an option in this case.
Prosecutor then says that the parties are discussing whether a misdemeanor-only plea offer is on the table, and that the govt is still considering that.

In the meantime, the judge sets a tentative trial date for Feb. 7, 2022

The Oath Keepers moved to dismiss the lawsuit filed by Rep. Bennie Thompson and other House Dems re: Jan. 6 (see: buzzfeednews.com/article/zoetil…)

The Oath Keepers are arguing:
- No House member individually had a constitutional duty to perform on Jan. 6 when the joint session of Congress convened to certify the election (only the House as an *institution*) so the insurrection couldn't be a violation of plaintiffs' duties
- That the allegations in the suit are too speculative/vague in terms of laying out facts that show the Oath Keepers as a group conspired with Trump and the other defendants to disrupt Congress that day and participate in the insurrection

DOJ filed notice late last night that it would partially defend the Trump admin's decision to keep a March 2019 memo secret that Bill Barr cited in clearing Trump of obstruction.

The case was briefed in the fall. This is first time DOJ under AG Garland weighed in, and lawyers said the judge had misunderstood the purpose of the memo and blamed "imprecision" in the govt's earlier briefs. The word "regret" appears five times.

Now: DOJ notifies the court that it will appeal a judge's order to release a March 2019 memo re: not prosecuting Trump for obstruction in the Russia probe. More to come shortly.
UPDATE: In an accompanying motion asking for a stay, DOJ explains that they're actually partially appealing — they're okay with releasing part of the OLC memo, but not all of it assets.documentcloud.org/documents/2078…
