Anti-trans groups tried to abuse the Judicial Review again and set new precedence for interpretations of the Equality Act and they LOST the case.

"Today the High Court of Justice has handed down a judgment rejecting claims that the Ministry of Justice’s policy on the care and management of trans prisoners discriminates against women" /1
"The prisoner (the claimant) argued that her human rights were violated by having to be in the same prison as trans women prisoners who have convictions for sexual or violent offences against women.

The claimant argued that the policies should be declared unlawful." /2

"Why is the case important?

The claimant was arguing for trans women to be treated less favourably than non-trans women in the context of prison policy. If these arguments were successful, this could have had wider implications... /5
... The case was potentially testing the Equality Act exemptions, as to whether it would be lawful to discriminate against trans women in particular cases... /6
...The claimant argued that the Ministry of Justice should be compelled to ... exclude some trans women from women’s prisons on the basis of group-based categorisations rather than on case-by-case risk assessments" /7
What was the court decision?

"The claimant’s arguments were rejected. The court ruled that the current polices are lawful and do not violate the rights of women prisoners.../8
...The court said the policies “do not involve an unjustified or disproportionate intrusion with the [Human Rights Act] Convention rights of women prisoners. /9
...As the judge said: “the minister was under no obligation to apply them, either generally or in any particular case.” This is an important ruling as it has wider implications for trans inclusion... /10
...For example, it helps to clarify that the exemptions do not create an obligation to exclude trans women from women only-spaces... /11
The court also recognised our concerns about the misuse of statistics. The judge specifically referred to the claimant’s “misuse of the statistics, which in any event are so low in number, and so lacking in detail, that they are an unsafe basis for general conclusions.” /12
"We see the struggles of all women as linked and reject attempts to divide our communities. This case is a win for all women as it reaffirms principles that some groups of women cannot be discriminated by over others" /13
“These types of discriminatory claims are nothing new and follow a long history of the demonisation of LGBTQ+ people. Just as our communities resisted that demonisation and stereotyping in the past, we will continue to challenge it whenever and wherever it arises today.” /14
“Group-based stereotypes and stigmatisation will not help to reduce violence in our communities. We need to address the underlying causes of violence, which are often related to inequality and discrimination.” /15
“We see this case as an opportunity to have much needed public conversation about the current conditions and issues that prisoners face, and the pressing need to make greater efforts to prevent and reduce harm both inside and outside prison.” /16

Trans allyship: a thread.

I've been asked to speak on panels about trans activism a lot the last few years, esp through pride month. One question I *always* get asked is: what can people do to be in solidarity/allyship. I've been asked it year on year on year:
1. Remember Trans ppl are many &not the same: This is true in v.many ways; the spectrum of trans men, women, agender, nb, genderqueer folks. But Trans people are also Black, PoC, disabled, autistic, poor etc. Don't centre white non-disabled transness &add the rest of us on later.
1a. This should be at the forefront of your mind when thinking about Trans solidarity, Black trans women, Trans sex workers, disabled trans people and poor trans people are all the *most* affected by anti-trans violence, and systemic inequalities.

When looking at movements throughout history they have a typical cycle of energy and activity. Most people think of a movement as existing in its “uprising” and it’s “peak”. These are stages when there’s been a “trigger moment” that kicks of rapid change and attention
There are lots of types of trigger moments but right now are unprecedented times in my lifetime and we are living through a few simultaneously (on different scales) e.g. COVID-19 and global lockdowns, the murder of George Floyd, the reform of the GRA and many more

1. JK Rowling is out here saying that trans ppl are trying to erase sex as a concept and that her life experience is as a female. Here’s a thread on why she’s confused.
Firstly, She’s dog whistling that trans ppls very existence denies the existence of sex
2. This is partly based on transphobia-specifically the idea that if a trans woman is a woman it erases&attacks all other experiences of womanhood (as opposed to understanding that groups of women experience different intersections of oppression. She should read some bell hooks)
3. It’s partly based on some trans ppl (myself incl.) believing sex is a social construct. This isn’t “trans ideology”, many trans ppl don’t care or agree. We aren’t a homogenous group. We are all just out here trying to live & survive while others make meaning of us and theorise
