Foreigners are permitted to visit India on certain visa conditions. None of the conditions permit them to take part in internal politics of India. It is against the law.
A foreigner entering India does not have the same rights that are available to an Indian citizen.
Indian citizens have certain additional rights incl. Fundamental rights, which is not available to Foreigners.
For Eg. Art 19 (1) All citizens have the right
(a) to FoS&E
(b) to assemble peaceably & without arms.
All "CITIZENS"...Not all "PERSONS".
Interpret that as you will.
If an adverse legal action is taken against a foreigner in India, he may take recourse to legal remedial action before the concerned authorities or courts. For that purpose, he might also criticize the Government action, before the concerned authorities / courts.
But physical protest against the Government of the country on political or general issues is not permissible to a foreigner because he is NOT AT PAR with the CITIZENS of India for this purpose..
Foreigners have to honour the laws regarding tourist, medical, student visa etc and are expected to not be indulged in activities which are not be permissible under these visa.
Para 10 of the Gen Policy guidelines for Indian Visa, specifically lays down that..
Foreign Nationals would be required to adhere strictly to the purpose of their visit declared while submitting the Visa Application !
So a foreign nationals dont have the same rights as Citizens of India, especially, when it comes to Article 19..
But they can certainly be subjected to various restrictions based on their activities, involvement,associations & movements.
The Govt can be lenient under certain circumstance,but if necessary,has the power to take action against such foreigner who is indulged in such activites.
Because, as a Foreign National on a Tourist Visa in India, Karl Rock is evidentially involved into Objectionable Activities which were Beyond the Scope of his presence in India.
