Read the case of Tengku Adnan bin Tengku Mansor. He is guilty as f**k. How two people can arrive at a completely different outcome is going to puzzle all the future law students.
2. Tengku Adnan was the Minister for the Federal Territories when he received the bribe of RM2 million. He was the Minister since 2013. He was brought down in 2018, when BN was outed by the People of Malaysia.
3. He had a company called Tadmansori which was incorporated in 1987. It's paid-up capital of RM100,000,000.00, with Ku Nan owning RM99,999,996.00 and the balance of RM4.00 by his brother Dato’ DL Tengku Rethwan bin Tengku Mansor.
4. Tan Sri Datuk Chai Kin Kong is a director in Aset Kayamas, a housing development company. He is a longtime friend of the accused. He had known the accused since the 80s, when he was then involved in the logging business in Jerantut, Pahang. The evil started with balak Pahang.
5. The FT Ministry in April 2013 launched an affordable housing project called “Rumah Mampu Milik Wilayah Persekutuan” (RUMAWIP). It targeted to build 80,000 affordable units by 2018. ubmitted by private companies. They begin their evil all in the name of bantuan rakyat.
6. Land belonging to DBKL and the Federal Government were utilised for this project. The project would be based on DBKL’s plans or or proposals submitted by private companies. Public Private Partnership is Najib regime's favourite phrase to steal public money and land.
7. Ku Nan after his appointment as Minister in 2013 asked Chai to participate in the affordable housing project. Chai obliged and had through several companies that he owned, including Aset Kayamas, bought several lands belonging to DBKL to implement the project.
8. Aset Kayamas had through a letter dated 26 January 2015 to Ku Nan, proposed to purchase a 4.05 acre DBKL land (Lot 53427 and Lot 53653) in Bandar Tun Razak, Kuala Lumpur. It proposed to build low costs housing and freehold apartments on the land.
9. Chai had on the 27.1.15 forwarded this letter to Ku Nan personally. Ku Nan penned his minutes on this letter in Chai’s presence:
“YBhg Data Zul Sila teliti cadangan ini dan jika boleh dilaksanakan mengikut kaedah kongsi sama. Harap maklumbalas sila bincang dengan syarikat”.
10. The minutes were for the attention of Dato’ Zulkifli Ibrahim, who was then the Deputy Director General of DBKL’s “Jabatan Pelaksanaan Projek dan Penye/enggaraan” . This department oversees the implementation and maintenance of DBKL’s projects.
11. Ku Nan's minutes, in essence, requested Dato’ Zulkifli to study Aset Kayamas’s proposal, and whether the project could be carried out jointly with DBKL.
12. Ku Nan was rebuffed by Dato’ Zulkifli who stated that there were already plans to build a hostel for DBKL’s training institute on the land. He also suggested that the application be forwarded to the Deputy Director General for planning, as it involves the sale of DBKL’s land.
13. Ku Nan then went to the Mayor of DBKL, Tan Sri Ahmad Phesal, who also stated that Aset Kayamas’s application could not be considered, as DBKL had already made plans to develop the land.
14. Kawan Cina Ku Nan Tan Sri Chai did not give up and continued to meet up with Ku Nan and Zulkifli. It was then agreed that DBKL would accept Aset Kayamas’s proposal, provided that it build a hostel for DBKL’s training institute adjoining the land, and then sell it back to DBKL
15. Aset Kayamas followed up by writing another letter dated 20.4.15 to Ku Nan. It contained a proposal to build affordable apartments for phase 1, and freehold apartments for phase 2. Tan Sri Chai had forwarded this letter personally to the accused.
16. Ku Nan wrote his minutes on the letter in Tan Sri Chai’s presence as follows:
“YBhg Data’ Seri Datuk Bandar, Seperti yang saya bincangkan semalam sila bawa ke OSC (One Stop Centre) untuk dipertimbangkan”.
17. A special meeting was held by the OSC on the 14.5.15. It was chaired by Tengku Adnan. They agreed to accept Aset Kayamas’s proposal. JPEPP then issued an internal memo dated 27.5.15 to Tan Sri Ahmad. (As Najib is getting caught in 1MDB, Ku Nan was stealing in his own way.)
18. The memo sets out Aset Kayamas’s proposal and JPEPP’s terms and conditions. It also sought for Tan Sri Ahmad’s agreement and highlighted that Ku Nan's consent, as the Minister for the Federal Territories, is required under the Local Government’s Act 1976.
19. TS Ahmad had on the same day issued a letter dated 27.05.2015 to Ku Nan seeking consent. Ku Nan gave his written consent. This is typical BN Gov style. The Minister initiates the project for his crony, his officers prepare the proposal and Minister approves it.
20. TS Ahmad followed through by issuing a letter dated 29.05.2015 to Aset Kayamas. In that letter, DBKL offered to sell the land based on the prevailing value plus 20% premium of its value. Aset Kayamas accepted the offer, and paid an earnest deposit of RM200,000.00 on 5.6.2015.
21. What happens next is critical for us to see how BN steal from people in the name of helping poor people. Please pay attention. While they agreed to give the land to the Tycoon, they have not agreed the price. Which idiot would do that? But apparently BN Government do.
22. The land of 4.05 acres in a busy Bandar Tun Razak was was offered to Aset Kayamas at RM25,562,400 through DBKL’s letter dated 18 August 2015. This works out to just RM144 per square feet. You can't get this price even in the fringes of Klang. But that was the price DBKL gave
This land that the DBKL sold to this Chinaman was not in the fringes of Klang but in the centre of Bandar Tun Razak very next to its famous lake. It is bound to fetch a very high price. And it is just 5 minutes drive to LRT Bandar Tun Razak.
23. Just for comparison, I have checked a recent advertisement for land in Bandar Tun Razak. It now goes at around RM2,964 per square feet. Forget about whether it is commercial or residential land as it all can be kowtim with DBKL based on zonal approvals.
24. So, even if we put a very conservative estimate of RM1.5k psf, 4.05 acres of prime land should have fetched RM264 million. So DBKL's price for the 4.05 acres is already with a steep discount of RM239 MILLION, never mind even if they justify this robbery by poor Govt valuers!
25. If the DBKL land were to be auctioned in a proper and transparent way, real developers would bid competitively, and DBKL would have been richer by many billions and using this money, they could build affordable homes themselves. But BN thieves won't allow that.

27. I have been diverging from the Tengku Adnan's case from point 21 onwards. Let's get back into the case. Despite a really poor and steeply discounted valuation, Ku Nan's crony tycoon was not satisfied with the pricing. He wanted even cheaper.
28. Aset Kayamas through a letter to Ku Nan dated 26.8.2015, requested that the price of the land be reduced to a NOMINAL VALUE and that the 10% DEPOSIT payment be DEFERRED. They are such a cheap skate they can't even pay deposit and wanted it at dirt cheap price.
29. Tan Sri Chai again forwarded this letter to Ku Nan personally, who then wrote his minutes on the letter for the Mayor’s attention. Ku Nan instructed the Mayor to defer the payment of the 10% deposit for another three months.
30. Mayor Ahmad had by then retired. His successor was Tan Sri Datuk Mhd Amin Nordin. Amin through a letter dated 8.9.2015 to Aset Kayamas, stated that DBKL had no objections to extend the payment deadline for the 10% deposit by another 3 months, i.e. 1.12.2015.
31. As for the request to reduce the price of the land, Aset Kayamas was informed that its request will need to be submitted to the MOF’s Valuation and Property Management department (JPPH). Aset Kayamas did just that but was informed on the 29.01.2016 that it was unsuccessful.
32. Despite MOF's rejection, Aset Kayamas went back to Tengku Adnan through a letter dated 3.2.16. It requested for 10% discount from the offer price. The company also requested that the deadline for it to pay the 10% deposit, which was by then overdue, to be extended to 1.4.16.
33. As usual, Chai handed this letter to the Ku Nan personally. Ku Nan agreed with both requests and appended his minutes on the letter for TS Amin’s attention. TS Amin then instructed the JPEPP director to carry out the Ku Nan’s instruction. (Yang Menurut Perintah culture!!!)
34. Finally, a price of RM20,538,519 was agreed for 4.05 acres through DBKL letter dated 16.3.2016 and to also extend the payment of the 10% deposit to 1.4.2016. That is RM116.42 psf. If we assume the market price is RM1,500 psf, that is a massive discount of RM244 MILLION!
35. After passing all the hurdles successfully, Aset Kayamas and DBKL then entered into a Sale and Purchase agreement dated 1 July 2016 for the land. With this, Aset Kayamas took full control of the land. Not sure when they eventually settled the full purchase price.
36. Next comes the interesting phase that will explain how the few Melayus in power sold out the country's wealth for cheap bribes.
37. An open auction of the land would have fetched hundreds of millions of ringgit extra for the coffers of DBKL. But Ku Nan decided to allot it cheaply to his longtime Crony. All for what? Cheap bribes in the name of political donation. How much was the bribe? Let's see.
38. Tengku Adnan was at that time was also the Secretary General of the Grand Old Corrupt Party UMNO, Malaysia’s largest national political party founded in 1946.
39. Tengku Adnan asked Tan Sri Chai for a "political donation." Ku Nan told Tan Sri Chai that UMNO needed around RM5,000,000.00 to RM6,000,000.00 for two upcoming by-elections. These are cheap bribes. For this, KL people have to suffer loss of over RM200 million.

41. TS Chai, even if it was a very cheap bribe compared to the lottery he won by buying the land cheaply, was unable to commit then. He only told Ku Nan that he would give the contribution when he has the funds. The accused told TS Chai to make the contribution to TADMANSORI!
42. Tan Sri Chai "did not know" *wink* who the company belongs to, nor did it cross his mind to ask the accused why the payment was to be made to Tadmansori and not UMNO. His companies had never dealt with Tadmansori.
43. Chai then decided to contribute even cheaper bribe of RM2 mil. He instructed his staff to prepare the cheque and signed it. The cheque concerned was a Hong Leong Bank cheque number 136822 dated 14 June 2016 made payable to Tadmansori.
44. Tan Sri Chai had handed this cheque over to the accused personally at the latter’s office in DBKL on the 14 June 2016, two days before the by-elections were scheduled to be held. Clear evidence of bribery transacted through the banks!
45. Tengku Adnan then handed the cheque to his driver, Nik Yahaya, on the same day, and instructed him to deposit the cheque into Tadmansori’s bank account with CIMB bank. Nik Yahaya banked in the cheque into Tadmansori’s account at the CIMB bank’s Damansara Town Centre branch.
46. That the cheque was duly presented on the 14 June 2016, and credited into Tadmansori’s CIMB bank account on the 16 June 2016, was confirmed by Khairolrony bin Kamrudin, a bank officer with CIMB Bank, and Rabiatul Adawiyah, Tadmansori’s Assistant Accounts Manager.
47. Rabiatul testified that Tadmansori had never made any payments to UMNO. Both Rabiatul and Dato’ Hasbi bin Jaafar, the Chief Operating Officer of Tadmansori, also testified that Tadmansori has never had any dealings with Aset Kayamas.
48. The case is water tight. But here is where Tengku Adnan and his bribe giver started to do some tricks and drama in the court.
49. As part of cross examination of primary prosecution witness Tan Sri Chai, Ku Nan's lawyer asked whether he had received any letter of acceptance/acknowledgement or receipts, to prove the payment made by Aset Kayamas.
50. Tan Sri Chai dramatically fished out what he claimed to be an official UMNO receipt from his wallet. Why he did not produce this earlier it was a mystery. Most likely it was never there. Instead he blamed MACC that MACC never asked him about receipt.
51. Why the hell he was keeping a receipt of a bribe he paid sometime in 2016 three years later in 2019 and coincidentally on the day of his cross examination, he gave a bullshit answer. But the AGC and the courts let him off lightly on this. nst.com.my/news/crime-cou…
52. But MACC did not take this setback lightly. They raided UMNO HQ on the same day evening and captured the purported receipt book only to find that the particular duplicate copy of the single receipt Chai produced missing from UMNO Headquarters. theedgemarkets.com/article/tengku…
53. The purported receipt that was produced by Chai was an original UMNO receipt no. 376241 dated 14 June 2016 for RM2,000,000.00, being “sumbangan PRK Kuala Kangsar dan Sungai Besar” (‘UMNO receipt’).
54. The receipt books seized by MACC were tendered through Farahdzilah binti Abd Kadir, the Deputy Head of the Finance Department at the UMNO headquarters, who was called by the prosecution to testify.
55. The prosecution focused on the receipt book from which the UMNO receipt was allegedly issued from. This receipt book contained the duplicate copies of receipts from number 376201 to 376250.
56. Farahdzilah stated that a receipt would be issued to the person concerned and that one duplicate copy would remain in the receipt book.
57. Like I said earlier, the duplicate copy of the UMNO receipt, however, was conspicuously missing from this receipt book. It was incidentally or conveniently the only duplicate copy missing. Farahdzilah could not explain and stated that the receipt books were easily accessible.
The scheming by the Prosecution witness and Defence became more apparent when the Prosecution pointed out major discrepancies in the order of the receipt book.
59. The prosecution highlighted through Farahdzilah that the first duplicate receipt (receipt number 376201) was dated 24 August 2017. The prosecution, however, chose to focus on the duplicate receipts that were issued before and after the UMNO receipt.
60. The receipt issued before the UMNO receipt (receipt number 376240), was dated 12 November 2018, and the one after it (receipt number 376242) was dated 16 November 2018. The UMNO receipt, however, was dated 14 June 2016. INCREDIBLE FRAUD!
61. If this happened in any other country's court, that Chinaman prosecution witness would also be facing jail for pulling this fraud on the Court but Malaysian courts are "kinder". They just gave free passage to everyone involved.
62. Ku Nan's lawyer gave another twist to it when he got Farahdzilah to agree to Ku Nan’s suggestion that Ku Nan had signed the receipt in his capacity as the “Pengerusi Badan Perhubungan UMNO Wilayah Persekutuan”, and that the donation was for that body, and not for the UMNO HQ.
63. These are the facts of the case on which the High Court Judge MOHAMED ZAINI MAZLAN J came to a conclusion that Tengku Adnan was guilty as charged and sentenced him to 12 months jail and RM2 million fine, an extremely light sentence compared to the harm he caused KL people!
64. Even this lightest sentence has been overturned so what is the reaction of @AGCPutrajaya who even appeals very petty cases to the highest level?
65. So Please Malaysians, do apply pressure on them as we do not want all corrupt politicians to escape punishment on the basis that the bribe they took into their personal bank accounts or their private company bank accounts as political donations.
66. If Tengku Adnan's case become a precedent, the whole Kluster Mahkamah facing graft charges could escape punishment and all our efforts to root out corruption will come to a naught. The End!

Most of the time, the Investigators and Prosecutors don't look at the total loss suffered by taxpayers as a result of bribery. Same thing happened in Ku Nan's case. For a cheap bribe of RM2 million, more than RM200 million loss in revenue to DBKL
When you don't tell the consequences of bribery, the society take these matters lightly and accept it as part of way of life in Malaysia. In Ku Nan's case, the bribe he took has costed KL residents 100 times more losses. This is the price of bribery!

Conspiracy theory aside, why does he allows opportunity for people to accuse him of such? Why he did not sue him until today? If this kind of things hold him from launching a frontal attack against KerajaanGagal and former Kleptocrats, he should pass the baton to others in PKR.
In developed countries, even the Opposition leaders resign and go if they can't win elections. Malaysia with its gerrymandering is not apple to apple but there must be a limit as to how many times one could fail and yet retain Opposition Chief Post.
Either he drives the Opposition to this Government from the front or allow someone fron his party to take charge and go full blown attack. Another problem is, no one stepping up with Rafizi firing mainly his own side instead of opponents.

If you ever kick out BN and PN again from Putrajaya in GE15 or earlier, don't compare your incoming politicians with BN and PN. That's no standard at all. Compare your politicians to the standards of New Zealand or Japan or if those two are too far, compare with PAP Singapore.
Comparing with BN and PN is really low bar. That's how you tolerated Guan Eng mixing with shady figures that has now resulted in a corruption charge eventhough the bribe amount alleged is too little compared to BN Standards of a similar size project.
If you compare with BN and PN standards, Mahathirists will be cool with his mixing with his favourite tycoons and receipt of gifts from them. Anwarists will be cool with him accepting private jet trips sponsored by his favourite tycoon.
