The 2020 election was a high point for voter turnout, in part because states expanded access to the polls. Now, a growing number of states are pushing baseless investigations into the 2020 election results and considering legislation that would limit voter access. #FoiaFriday
Partisan election “investigations” are gaining traction...Arizona is currently conducting a biased “audit,” Wisconsin’s top Republican has hired three retired police officers to conduct a review, and a Pennsylvania legislator is now pushing a “forensic investigation.” 2/
By furthering lies about voter fraud, bogus ballot reviews provide a pretext for voting restrictions and other harmful measures. And proposals to restrict access to voting have exploded across the country. 3/
These suppression efforts include state laws that make voting harder, such as those currently being considered in Michigan as well as in Texas, where Gov. Greg Abbott called a special legislative session to again take up a voter-suppression bill. 4/
Texas Democrats left the state this week in an attempt to block a vote on that voting restrictions bill. 5/
texastribune.org/2021/07/12/tex…
Some proposals to restrict voting rights have already become law. In Georgia, Republican leaders passed a law in March 2021 that critics say amounts to blatant voter suppression thanks to the many new restrictions it places on access to the polls. 6/
In Florida, another law enacted in the spring restricts absentee voting by requiring that ballots be requested before every federal election, rather than once every four years, and by adding ID requirements for requesting a ballot. 7/
Arizona is another hotspot of anti-voting actions, with new restrictions on mail-in voting as well as a plan to allow the legislature to overrule state election results and choose its own slate of presidential electors. 8/
americanoversight.org/investigation/…
The Arizona state legislature recently voted to revoke Arizona Secretary of State Katie Hobbs’ authority in election lawsuits, instead giving that power to Republican Attorney General Mark Brnovich (but only until the next election for those offices, in 2023). 9/
There’s more. Idaho’s H.B. 88 would prohibit third parties from returning an absentee ballot for anyone except immediate family members. 10/
In Kansas, S.B. 292 would also limit community ballot collection by requiring an additional signed affidavit from the voter and the ballot deliverer, while prohibiting people from collecting more than five ballots. 11/
In Wisconsin, where remote ballot collection boxes helped push the state’s record absentee voter turnout in 2020, S.B. 209 would ban drop boxes not attached to a local municipal clerk office’s permanent location. 12/
In Montana, S.B. 196 would allow some polling places to limit their hours. And in West Virginia, S.B. 565 would eliminate automatic voter registration. 13/
We’ve filed records requests in each of these states to shed light on the origins of and influences behind the new proposals. 14/

The Arizona Senate held a hearing today to discuss the preliminary findings of its biased “audit” of the 2020 election results in Maricopa County. We’ve been skeptical of this process since it began. Here’s why.
The sham “audit” is not based on any evidence of widespread voter fraud, in Maricopa County or elsewhere. In fact, an independent audit in February confirmed that the ballots in the county had been tabulated accurately and that there were no irregularities.
We are also concerned because many people involved in the process support the “Big Lie” of widespread voter fraud and/or far-right conspiracy theories. This includes the head of Cyber Ninjas, the firm the Arizona Senate hired to conduct the audit.

BREAKING: The court has denied the Arizona Senate’s motion to dismiss our lawsuit seeking “audit” records.

“It is difficult to conceive of a case with a more compelling public interest demanding public disclosure and public scrutiny," wrote the judge.

With the Arizona Senate moving ahead with its partisan audit — including a hearing scheduled for later today — it's essential for the public to get the full story about how this process has been conducted.
Our public records requests in Arizona have already revealed troubling conduct by officials leading the so-called "audit.” But critical records are still being withheld from the public.

Wisconsin has joined a growing list of states where allies of former President Trump have launched bogus “investigations” as part of an effort to perpetuate the big lie that the election was stolen. Here’s what’s happening and how we’re investigating.
On May 26, 2021, more than six months after the 2020 presidential election, Robin Vos, Wisconsin’s top Republican lawmaker, announced that he would hire three retired police officers and an attorney to conduct a new investigation of the election results.
We jumped right to action and sent public records requests to Vos' office, as well the offices of state Reps. Joe Sanfelippo, the vice chair of the elections committee, and Janel Brandtjen, the current chair.

New: We obtained first-person accounts of the conditions in detention centers last spring. Many people in detention were exposed to Covid-19 through cramped quarters and continual detainee transfers. They lacked consistent access to face masks and soap.

On March 23, 2020, an individual held at Krome Processing Center in Miami, Fla. wrote: “We are cooped up in here with 110 plus detainees, people are coughing, sneezing, getting headaches and getting uncomfortable…”
On March 31, 2020, an immigrant held in detention at Batavia Processing Center in Buffalo, New York, claimed that employees were not wearing masks and gloves at all times, even though doing so was necessary to help limit the spread of Covid-19.

Donald Trump has worked for months to undermine faith in the 2020 election results in Arizona. Now, Trump will appear at a rally in Phoenix around the same time results of the Arizona Senate’s partisan “audit” are expected to be released.

Records we obtained show that in December, as Donald Trump and his lawyers worked to overturn the results of the election, Senate President Karen Fann told a constituent that Trump had personally called her to thank her “for pushing to prove any fraud.”

Fann also said that she’d had numerous conversations with Rudy Giuliani in the weeks since the November election. Fann told the constituent that she had “the full support of him [Giuliani] and a personal call from President Trump thanking us for pushing to prove any fraud.” Image

We obtained visitor records for former Trump administration Attorney General William Barr.

The records further demonstrate the close contacts between Barr & John Durham, the U.S. Attorney tapped to probe the origins of the Russia investigation as a counter to the Mueller report.
The records show Durham visited Barr 3 times from June to Sept. 2019. Records we previously obtained showed Barr was unusually involved in Durham’s investigation—meeting with him 18 times in the 7 months after the Mueller investigation ended in March 2019.

This is yet another indication of the Trump administration’s politicization of DOJ. Uncovering how the former president used the agency to protect himself and his allies is an important part of understanding his impact.
