Even if he didn't, the clerk could deny the public financing based his opinion, and let the courts decide. This would tie up Manny in appeals for several more weeks or months, by which point he's a month or so out from the election itself.

Rather than continuing on with his campaign in spite of this hurdle, rather than fighting on and overcoming a system that's working against him--and campaigning based on that--he's signaling defeat, using it as an excuse for a November loss.
