The city clerk has granted @MannyForABQ a "due process" hearing. The clerk will present the allegations and evidence.

Manny has already seen the evidence. Multiple articles were written about his response.

Manny can deny the allegations, but his attorney already admitted that some of the signatures were forged.

"Gonzalez's lawyer admitted that some signatures appear to be forged" (KOAT)

Whatever your feelings are about the severity of the campaign rule violations themselves, the attorney admitted guilt, and the city clerk is thus not in a position to reverse his original decision.

For one, he has an admission of guilty.
4/

Even if he didn't, the clerk could deny the public financing based his opinion, and let the courts decide. This would tie up Manny in appeals for several more weeks or months, by which point he's a month or so out from the election itself.
5/

And if the Manny campaign's response so far are any indication of his attitude about the issue, he's going to lay down.
6/

“This would be no more than a political execution on our campaign” Manny said.

“The Clerk has illegally delayed our funding for almost two months, essentially silencing our campaign...” campaign manager Shannan Calland said
7/

"political execution"?
"silenced"?

He's signaling defeat before he's even lost because he knows he's not going to get the public financing.

His response is revealing.
8/

Rather than continuing on with his campaign in spite of this hurdle, rather than fighting on and overcoming a system that's working against him--and campaigning based on that--he's signaling defeat, using it as an excuse for a November loss.
9/

They say there's no such thing as bad press. But if your only press is the local media talking about campaign fraud allegations, campaign fraud hearings, and campaign fraud appeals, the name on the ballot will be associated in the minds of voters with...campaign fraud.

Disclaimer: I'm not a lawyer (though my experience with the Service Contract Act is above average).

It seems Biden's vaccine rules won't apply immediately and may not apply for up to a year.

[1/3]
According to the executive order, the new vax rules apply to new contracts, renewals, and option year extensions.

For recently awarded contracts, the vaccine requirements won't apply for up to a year, potentially.

[2/3]
That's how contractors pay out federally mandated adjustments to health & welfare. The gov't could increase H&W tomorrow, but if you started the new option year yesterday, it will be 364 days until you get the H&W bump.

=Biden is just posturing.

Judge says Manny needs to be informed of the allegations against him, needs to receive an adequate explanation of the evidence against him,, and needs to have an adequate opportunity to explain his position.

[excerpt/thread]
2/ If that sounds encouraging, it’s not — because in fact Gonzales was informed of the allegations against him, did receive an adequate explanation of the evidence, and did provide an explanation of his position.

...
3/ All of this occurred during a seven-hour appeal following the city clerk’s decision, during which Gonzales’ attorney acknowledged that possibly hundreds of qualifying signatures were signed by campaign staff, not voters themselves.

This is going to piss some people off, but it's true. Parents relinquished their power to bureaucrats, now their kids heading home anyway.

The rule of 'acquiescence out of convenience' proved useless.

theconservativenewmexican.com/2021/08/18/ant… #unmaskourkids
Excerpt: "The power of defiance lies in action. If you claim to be vehemently opposed to masking your children as a condition of returning to school, then don’t do it.

Sadly, few parents carried through on their threat to remove their kids from school if masks were required."
"They knew the science and ignored it out of convenience. The frustration comes from knowing that if more people had put their foot down — and left it — our schools would be half empty and our public officials would be changing their tune."

Fake news.

We are such a soft, decadent society.

If you're just "getting by" on an income that's 125% over the poverty line, you don't know poverty.

For a single person to "get by" according to this: $29,057 income per year, which is $14 an hour, $7,217 over NM's minimum wage ($10.50).
$29k a year will support a family of four with $2,500 to spare. It's 125% over the poverty line for an individual.
