Modern day ulema have been more concerned with figuring out how to manipulate classical fiqh to give non breathing corporations rights and protections and ensure their well being, than figuring out how to ensure the life, safety and dignity of breathing Muslim women
They’ve given the green light to Muslims abide by almost all modern western legal assumptions of the corporation as a legal entity. But have not been able to muster up the effort to protect the lives and assets of Muslim women
Secret marriages for example, literally put women’s lives at risk due to new knowledge of sexually transmitting diseases, yet some ulema insist on its permissibility. A woman’s right to make her own health decisions about her body, to the point of potential death, isn’t a factor.
If Muslim women request that existing wife’s knowledge be made a condition of entering into new marriages as her health is at risk (a man can secretly marry a 6 prostitutes every weekend) ulema will contest that.But they have allowed newly thought up legal rights for corporations
Perhaps as Muslim women we can register ourselves as corporations and then we will have more rights to seeing our contracts abided by, our assets protects and our interests considered paramount and subject to legal protection
