Time for Texan Muslim women to sue their state for violation of their religious rights to abortion, or at least an exemption based on religious beliefs that permit abortion on various grounds. And yes, there are NUMEROUS fiqh positions on the subject. For some those grounds are
just as narrow as the Texan law. And for some those grounds are as wide as permitting it for any reason before 40 days and permitted after the 40 day mark to preserve the pregnant person's life. Lots of positions on the matter.
Amazing that because people are comparing Texan govt to taliban (you've seen the memes & tweets), the usually fiqh-thumping-anti-abortion-misogynists are now touting abortion permissibility in many schools of thought/fatwas as a way to point out political liberals' islamophobia.
Meanwhile they too have been highly influenced by evangelical arguments against abortion. And love to send hate to faithful Muslim women who are trying to support other women through abortion experiences.
Support *each* other, that is—because Muslim women do indeed have abortions for various reasons.
Salaam everyone. If you're a Muslim woman who has had an abortion, I would honor the chance to interview you anonymously for the Gender in Islamic Medical Ethics Project. Please DM me for a judgement free conversation. Correspondence & convo will be completely private/anonymous.
I have written on the inadequacies of fiqh as a discourse to address abortion in islam in a recent article in the Journal of Religious Ethics called "Authority and Epistemology in Islamic Medical Ethics of of Women's Reproductive Health." This article and all my Islamic medical
ethics research Muslim women's experiences. I'm happy to send the article to anyone who doesn't have access. onlinelibrary.wiley.com/doi/full/10.11…

At last, as promised, a thread about the overall arguments of #GenderedMorality: Classical Islamic Ethics of the Self, Family, and Society (@ColumbiaUP, 2019). This book came about because of my interest in gender in Islam and Islamic ethics.
An expansive gender & feminist critical discussion of the akhlaq genre (philosophical ethics) didn't exist so I decided to write one. I examine 3 foundational classical akhlaq texts by al-Ghazali (yes, THAT Ghazali), Nasir ad-Din Tusi, and Jalal ad-Din Davani.
I analyze concepts of masculinity, femininity, marriage, and homosocial male relationships. I argue that even though the ethicists’ metaphysics had potential for radical equality, they sincerely believed that humanity was created on a hierarchical scale of rationality:

Starting a new book project on gendered experiences in IslamicBioEthics. Finally wrote up a thread on the IslamicBioEthics of abortion & why most Muslim jurists permit it up to 120 days (17wks). Esp for responding to anti-Muslim framing of American abortion bans as Islamic.
Most jurists permit abortion for any reason up to 120 days after conception, which they mark as the moment of *ensoulment* and after 120 days in case of grave danger to the mother or severe/fatal abnormalities of the fetus.
This is based on their reading of Qur’anic verses 23:12-14, 32:7-9 in conjunction with a hadith about the various stages of gestation. The verses outline stages of human creation that are parallel to fetal development, translate to: “Verily, We created the human from an essence..
