I committed an expatriating act by acquiring Czech citizenship in May 2021 with the intention of relinquishing U.S. citizenship. I obtained this naturalization in a foreign state voluntarily & upon my own application. #FATCA
As far as I or the Immigration & Nationality Act is concerned, I ceased to be a U.S. citizen the day I became Czech. I am now, however, caught in a very dangerous and paradoxical precedent in which my Loss of U.S. nationality is retroactive but I have no CLN to confirm it. #FATCA
I am essentially a U.S. citizen because I don't have a CLN, but not really because I already have committed my expatriating act with intent and a CLN would be backdated to this date should the U.S. Embassies and Consulate ever bother to recognize it. #FATCA
I am essentially only a Czech citizen, but not really because without a CLN I can't invest like any other normal EU citizen. Tell me again, @StateDept, how this piece of paper is worth 2,400. Because that's all that's stopping me from living a normal life. #FATCA
Any doubts raised by any U.S. government official to the fact that my acquisition of citizenship was indeed a naturalization obtained upon my own application should refer to Fox v. Clinton. #FATCA
R.S. §1999: "Therefore any declaration, instruction, opinion, order, or decision of any officer of the United States which denies, restricts, impairs, or questions the right of expatriation, is declared inconsistent with the fundamental principles of the Republic." #FATCA
Farrell v. Blinken: “In any event, executive recognition is neither legally nor practically necessary to expatriate... #FATCA
Farrell v. Blinken: "By its terms, the INA provides that a United States national “shall lose his nationality by voluntarily performing” an expatriating act “with the intention of relinquishing United States nationality.” 8 U.S.C. § 1481(a). #FATCA
Farrell v. Blinken: "And the specific expatriating act Farrell insists he performed in '04—applying for and obtaining Swiss naturalization in Switzerland as an adult—requires no action by the federal executive at all, much less advance recognition to make it effective." #FATCA
Farrell v. Blinekn: For such expatriating acts, citizenship is “lost automatically, without any administrative or judicial determination.” United States v. Yakou, 428 F.3d 241, 249 (D.C. Cir. 2005). #FATCA
Me: Consulates whom I contacted are infringing upon my right to expatriation as per R.S. §1999, as no U.S. law stipulates that I must be a resident in the country in which I am formally renouncing or relinquishing my U.S. citizenship. #FATCA
Give me my CLN so I can exit this #FATCA prison cell!
