1. On this Labor Day, a reminder that the FTC Act’s prohibition on unfair methods of competition and unfair or deceptive practices means that businesses directing these tactics at workers are breaking the law.
2. In February, FTC charged Amazon with deceiving its delivery drivers and pocketing $61+ million in workers' tips. According to the complaint, Amazon lured drivers by promising $18-25/hr plus tips but then quietly cut pay and diverted tips. ftc.gov/news-events/pr…
3. FTC & DOJ have also charged businesses with colluding to keep worker pay low. While antitrust enforcers have not always prioritized worker harms, DOJ has started to pursue criminal charges against employers who agree not to hire each other's workers. justice.gov/opa/pr/davita-…
4. Given imbalances of power in the workplace, vigorously enforcing the law when bosses are violating the FTC Act is critical. Increasingly pervasive worker surveillance renders our efforts in this area especially vital.
