Avenatti just filed his opposition to prosecutors’ @Tabs3Software motion, and it raises a lot of interesting issues. Prosecutors admit they don’t have Tabs data “and therefore had no idea whether the information is favorable to the defendant.” bit.ly/3BLVnjN
I'm on the call for Avenatti's status conference in @StormyDaniels case. Avenatti is on the line, too. Everyone else is in Judge Furman's courtroom in Manhattan. Furman says "realistically" if they're going to do a. jury questionnaire, the Jan. 10 trial date isn't feasible.
Judge Furman said he's leaning toward not using a questionnaire. He's influenced by his colleague Judge Paul Oetken, who seated the jury in the Lev Parnas trial in a day without a questionnaire.
Prosecutors say they’re fine proceeding without a questionnaire. “We do have a victim interested in proceeding and obtaining justice,” prosecutor says of @StormyDaniels.
But the defense wants a questionnaire, so they’re calling to adjourn the trial date.
Defense says Avenatti’s cases “continue to garner significant media attention.” (That means this thread is going to get a lot of attention, right? Right??) Furman says: “I’m not suggesting that he is an unknown figure.” But with the passage of time, there’s not as much coverage.
Furman said he also doubts Avenatti's trial will garner more coverage than Lev Parnas' coverage, which involves Trump and Guiliani. He's taking under advisement and there will be briefs. Judge has a backlog and doesn't want trial moved to March.
Furman asks about Avenatti's California trials, and defense says "there is ongoing litigation with respect to the retrial that I believe is currently scheduled for November." He also mentions the 9th Circuit appeal.
I posted last night prosecutors' motion to the 9th Circuit to dismiss Avenatti's appeal ASAP or affirm Judge Selna's rejection of the double jeopardy motion.
Prosecutors just filed their brief on whether Judge Selna has jurisdiction over Avenatti's case while the 9th Circuit appeal is pending. "This Court is not divested of jurisdiction simply because defendant has filed a frivolous appeal..." bit.ly/2YWDMaL

Interestingly, Judge Selna seems to have basically set up this looming 9th Circuit-driven trial delay by inviting Avenatti to file that double jeopardy motion. He made it pretty clear he didn't think the issue had any legal merit, but he invited the brief anyway.

I got here early, so I walked a little extra to bring you that new angle of the marble tower that is the Ronald Reagan Federal Building and Courthouse. Fun fact: @USGSA imported marble from Italy to build this place, and officials traveled to Italy a couple times in the process.
Judge Selna scheduled this status yesterday afternoon. No word on the specific topic, but it follows briefs on whether he has jurisdiction with the pending 9th Circuit appeal.

Here’s a new thread-worthy one: Lawyers suing Cardi B (@iamcardib) wanted her sanctioned and ordered to trial ASAP after she partied in Paris following a trial delay related to her newborn son. But U.S. District Judge Cormac Carney here in Orange County said no.

Chemerinsky took issue with the title of the program, “Tribute to a Legal Giant.”

Chemerinsky says he agreed to the program before he knew who it was about. When he realized it was about Thomas, he suggested @OCBarCA find another speaker. But event organizers told him to speak his mind. So, off he goes. He's really laying out a case against Thomas right now.

AUSA Patrick Fitzgerald tells the the judge the remaining indexing of the last 2.3 million files is going "very, very slowly." Just before this hearing started, Avenatti filed notice of his appeal to the 9th Circuit re: Selna's denial of his mistrial motion.
It was a hectic morning for my commute , so I'm a little behind and need to post that 9th notice ASAP. But I'm here in Selna's courtroom and they haven't said anything about the appeal yet. It's been all Fitzgerald.

Avenatti just filed a status report ahead of tomorrow's 8 a.m. conference with Judge Selna, and he's decrying late disclosures that he say contradict testimony from expert witness John Drum, others: bit.ly/3v0nV6s
This 121-page filing includes examples of remaining TIFF images @TheJusticeDept has yet to index on Avenatti's last law firm server. Avenatti is citing them to show Judge Selna the remaining unindexed info isn't mostly graphics like DOJ said. bit.ly/3v0nV6s
