Today’s the day! Senate Judiciary expected to vote on Jonathan Kanter nomination for @JusticeATR, the second to last step before his confirmation.
Now on to Kanter!
Sen. John Cornyn (R-Texas) says while he appreciates Kanter's focus on Big Tech, the antitrust division is broader than that and he is concerned about Kanter's criticism of the consumer welfare standard.
"I don't support undercutting important antitrust principles for short term political goals," Cornyn says.
Sen. Amy Klobuchar (D-Minn.) is now talking about all the Republican support for Kanter. "We are at a critical moment for antitrust," she says. "There may be differences on certain answers. Overall, he is where this committee is" on antitrust.
Sen. Josh Hawley (R-Mo.) says he has some differences with Kanter but he is a yes “The biggest problems we face in the tech sector have to do with the hyperconcentration. ...I do appreciate [Kanter's] understanding that the hyperconcentration in the tech sector is a big problem.”
Sen. Sheldon Whitehouse (D-R.I.) is talking about the DOJ antitrust investigation into car emissions and how the DOJ has foiled his attempts to get documents underlying the decision to open this probe.
"I don't want to be slow-walked or denied information. I'm getting really frustrated by the slow-walking and dribs and drabs of information we are getting out of the Department of Justice."
Sen. Richard Blumenthal (D-Conn.) says he supports Kanter.
SJC voice votes Kanter's nomination. Cornyn asks to be recorded as a no.

🧵I don’t post personal news much, but wanted to share why I support @penguild. I became a journalist because I believe very deeply in transparency and sharing information so people can make decisions informed by facts.
My colleagues at @politico and @EENewsUpdates are among the best in the business and I’m proud of how our hard work and dedication influence policy and politics the world over.
In my 15 years, I’ve been involved in 4 sales the latest Politico’s to Axel Springer. Each one has led to changes in benefits, bosses and sometimes layoffs. The day the sale closed, Politico informed us that because of an oversight our 401K and FSA are frozen for the rest of 2021

First key stat unsealed: "Google’s exchange processes about 11 billion online ad spaces each day."
"Google owns the largest buy-side and sell-side brokers. As one senior Google employee admitted, '[t]he analogy would be if Goldman or Citibank owned the NYSE.'"

In her briefing with reporters, EU VP Margrethe Vestager declines to comment on whether she will meet with Apple CEO Tim Cook, who also happens to be in New York today.
But Vestager said they are watching what Apple does to respond to the Epic decision. "We are not bound by the judgment in the Epic case because it’s not our jurisdiction but we will follow with great interest [Apple's] response to the judgment."
"It will be interesting for us to see how they implement this. It is very early days and we have no idea how it will be implemented. [The Epic decision] it has no impact on our casework.

Inside Lina Khan’s war on monopolies…
The FTC offers two on-the-record responses to my story from this morning. “It is not clear why this executive flew to D.C. with the expectation of meeting in person. Due to Covid-19, the agency remains under a mandatory telework policy, meaning no one is in the building...
..and visitors are discouraged from coming to the building. Furthermore, when the agency is involved in active administrative litigation against a company, Commissioners must abide by the agency’s and the Administrative Procedure Act prohibitions on ex parte contacts...

Back to our regularly scheduled programming: In just a few mins, Judge Castel up in NY is holding his first conference in the Google advertising antitrust cases.
One thing he may rule on today: how much of the complaints becomes public. @politico and other news org via @rcfp had some views on that we shared with the court last week (We want it all unredacted, pretty please!)…
I am covering remotely, which means we get to start by playing that fun game: "how many people does it take asking for everyone to mute before it finally happens"

Some news from FTC Chair Lina Khan: Holly Vedova and Sam Levine will take on the permanent bureau director jobs…
She also lays out three priorities for the agencies work:
1) discouraging a wave of illegal mergers that has overwhelmed the agency;
2) investigating companies that act as “gatekeepers and dominant middlemen” in the economy;
3) and combatting unfair contract terms.
She also advocates for taking an interdisciplinary approach that would see BC and BCP less siloed and working more with technologists, data analysts, financial analysts, and other experts
