CHUTKAN is incredulous that Trump is saying there's no legitiamte legisaltive purpose behind the Jan. 6 committee's probe.
The attack, she says, occurred in "literally Congress' house."
CHUTKAN also says Biden's decision to waive privilege carries more weight than Trump, a former president's, attempt to assert it.
"The person best able to determine whether there’s an executive privilege is the current executive," she says.
MORE CHUTKAN
"There is only one executive."
"In a rare instance, the executive branch and the legislative branch are in agreement. They both agree that the documents should be turned over. I don’t see where the separation of powers argument exists."
CHUTKAN does agree with Trump lawyers that "some" of the requests for information by the Jan. 6 committee are "very broad."
She raises requests for polling data and election issues as far back as April 2020.
"That seems to me unbelievably broad."

UPDATE: Jan. 6 committee Chairman Bennie Thompson tells me contempt is “on the table” after former Trump DOJ official Jeffrey Clark declined to answer questions during a brief deposition.
Clark claimed a mix of executive/attorney privileges.
Howell, a longtime aide to Sen. Patrick Leahy on the Senate Judiciary Committee, has channeled the outrage felt by many on Capitol Hill. And she’s encouraged convicted Jan. 6 rioters to cooperate with House investigators.
Chutkan’s biggest moment comes today, when she hears Donald Trump’s lawsuit to stop Congress from accessing his White House records. Her ruling there could help unlock reams of sensitive new evidence. politico.com/news/2021/11/0…
Detained Jan. 6 rioter and Proud Boy Christopher Worrell has told judges, interviewers and his own lawyers he never confronted/threatened Capitol Police.
Prosecutors reviewed new videos and now say he has repeatedly lied to them all.
Prosecutors also say they have new indications Worrell deleted evidence from his phone before his arrest. And they say since his pretrial incarceration he’s repeatedly misrepresented his access to medical care.
WOW: Judge LAMBERTH is going to release Worrell to home confinement, saying the conditions at DC jails are so horrific he can't ensure Worrell will be "safe" as he prepares to undergo chemotherapy for cancer.
Lamberth will move Worrell to Alexandria jail temporarily today.
NEW: Donald Trump has responded to the Jan. 6 committee in court, urging a court to slow down investigators’ effort to obtain his White House records. He wants a document-by-document review that could take months.
In his filing, Trump claims the FBI and Senate have concluded there was no overarching conspiracy behind Jan. 6 attack. This is not true in either case. politico.com/news/2021/11/0…
