On Oct. 8, we sued the Wisconsin Assembly & Speaker Vos for these records. Within a few hours, the judge ordered the defendants to release records within 30 days or show cause why they could or would not. Today, the judge found their reasons insufficient.

Speaker Vos and the Wisconsin Assembly launched their partisan election review back in May. In June they contracted with former state Supreme Court Justice Michael Gableman and several retired police officers to conduct the review.
In court today, the Assembly insisted that it should not have to turn over records held by Gableman, arguing that Gableman works for a separate entity called the “office of special counsel.”
But the Assembly didn’t formally designate that office until Aug. 27 — nearly three months after the investigation started.
The judge said that it is a “shell game” to claim that the office of special counsel, not the Assembly, has the records created before Aug. 27, and ruled that the Assembly and Vos must release them within 10 days.
