1/4 This thread shows a key change in the language of the jury instructions on Citizen's Arrest, which dominated Friday's charge conference. Up first is the language the state wanted:
2/4 "A private citizen’s warrantless arrest must occur immediately after the perpetration of the offense. If the observer fails to make the arrest immediately after the commission of the offense his power to do so is extinguished, and subsequent arrest is illegal."
3/4 This is the language the judge chose: "A private citizen’s warrantless arrest must occur immediately after the perpetration of the offense, or in the case of felonies during escape."
4/4 The defense isn't happy with that language, but says it's an improvement. They insist their clients' probable cause for Citizen's Arrest accrued in the weeks before the fatal shooing, so arrest attempt of #AhmaudArbery wasn't "immediate" @FCN2go
