HAPPENING NOW: Oath Keeper James BEEKS is appearing for a hearing and immedaitely objects to being represented by a lawyer, claims he's there in his "divine" authority as an American citizen
Judge Howell is not pleased with his "gobbledygook."
DOJ is now seeking to detain Beeks pending trial. They say they didn't know until just now that he rejected the entirety of U.S. law and the court system.
Pretty remarkable turn for James Beeks. DOJ was not preparing to seek his pretrial detention, but the actor's performance in front of Judge Howell may have convinced her to incarcerate him pending trial.
After a brief side conversation with federal defender Michelle Peterson, Beeks is suddenly willing to allow her to repreesnt him.
But Howell says she can't "erase" what she just heard.
BEEKS nearly moonwalked himself into pretrial incarceration, but the Michael Jackson impersonator / Judas portrayer will instead be on home detention pending trials.
He just needs the FBI to return his car keys and "gold and silver."
Beeks will now be driving from Wisconsin to Florida in time for a Wednesday morning court hearing — a fairly risky proposition for a guy who just moments ago said he rejected all legal authority over him. politico.com/news/2021/11/2…
NEW: Federal judge says Jan. 6 "pawns" are paying the price, while Donald Trump and those who led disinformation campaign about the 2020 election have not been held accountable.
Judge MEHTA: “We’re here today deciding whether Mr. Lolos should spend 30 days in jail when those who created the conditions that led to Mr. Lolos’ conduct, led to the events of Jan. 6 [haven’t been] held to account for their actions and their word.”
Mehta said other judges in D.C. hadn't fully expressed this point.
“Once you hear people who should know better tell you that an election was stolen and they say it loudly enough, frequently enough, it’s not surprising that people will believe it.”
BREAKING: The DC Circuit Court of Appeals has granted a brief hold on the Trump executive privilege decision, setting a schedule that includes arguments on Nov. 30.
THE PANEL:
Judge Patricia Millett (Obama)
Judge Robert Wilkins (Obama)
Judge Ketanji Brown Jackson (Obama/Biden)
IMPORTANT: The House and DOJ did *NOT* oppose this temporary hold. They got a pretty quick briefing schedule out of it. Puts them on track to get documents in early December, if they prevail.
HAPPENING NOW: A judge is preparing to sentence Scott FAIRLAMB, the first Jan. 6 defendant charged with assaulting a police officer during the attack to be sentenced.
NEWS: Proescutors are seeking a 51-month ail sentence for Jacob CHANSLEY, the so-called "QAnon Shaman" who stormed the Senate and scrawled a meancing note to Mike Pence.
@joshgerstein Chansley has become the most infamous defendant to breach the Capitol. Images of him shirtless, wearing a horned viking hat on the Senate rostrum — just after VP Pence was evacuated — helped define the insurrection.
@joshgerstein "When rioters flooded the U.S. Capitol and the defendant took the Senate dais, they accomplished the goal so many could never have imagined—they halted the peaceful transfer of power upon which our democracy is built."
BREAKING Judge Tanya Chutkan has rejected Donald Trump's effort to block the Jan. 6 committee from accessing his White House records, determining that Biden's decision to release them is more significant.
"Presidents are not kings, and Plaintiff is not President," she writes.
The ruling is a significant victory for the Jan. 6 committee's effort to peer into Trump's mindset as he stoked false claimed about voter fraud and sougth to delegitimize the outcome of the 2020 election.
