Threaded these two cases because they highlight something judges have been grappling with all year: How liable are misdemeanor defendants for the violence on Jan. 6? Judges will often point out that the violence was made possible by the size/coverage of the mob as a whole...
...while also acknowledging that the specific misdemeanor crimes that are being charged in nonviolent Jan. 6 cases can't be treated the same as the more serious ones. It's an ongoing tension that they're working through in these hearings
