HEADS UP: Detention hearing begins shortly in high-level Capitol breach case of Mark Mazza
He's accused of brandishing baton & being part of "heave-ho" push against police line amid the mob at Capitol
Charging documents say Mazza yelled at police, "This is our f**** house!"
And we're underway. Judge is asking series of questions.. and Mazza says he's not been getting his meds, while in pretrial jail
Hearing is halted. Might not be able to go forward with a pretrial detention hearing. Judge is shifting parties to private meeting
Two high-level Jan 6 defendants were scheduled for detention hearings today, for judge to decide whether to keep them in jail
Both hearings are botched. One defendant's location was unclear (in transit to DC) The other says he's not getting his meds
Holiday week confusion
Mazza says he's experiencing "nausea and headaches" .. but they will plow ahead with detention hearing
Standby... this is a high-level case
Prosecutors are making argument for pretrial detention for Mazza, arguing he had a stolen DC police baton
And... arguing Mazza dropped a gun while amid the mob on Jan 6... at about 3pm
Prosecutor says, "This gun was loaded.. with three shotgun shells" ... and with "hollow-point shells.. that expand out and cause more damage"
Prosecutor tells judge Mazza lost his gun as a US Capitol Police officer was being assaulted. But feds say they have not charged Mazza with that assault ... at least not yet
A search for relevant body worn camera video is underway, prosecutors say
Prosecutor describes "wave after wave" of rioters assaulting police on Jan 6
He says Mazza entered the tunnel just after 3pm on Jan 6.... and was pushing with the crowd to "break the line" of police officers
Feds are showing lengthy video, including the "heave-ho" of mob in tunnel
And a video in which prosecutor say Mazza is heard saying to police "Get out of the citizens of the United States way"
Prosecutors allege Mazza was coordinating and pulling people into Capitol.... "getting other protestors and rioters to enter the tunnel area"
Striking one officer and hold door as others assaulted police, per feds
Prosecutor says Mazza not only stole a DC police baton, but "kept it for himself"... and they cite recent criminal history, including battery incident after Jan 6
Prosecutor says there were 1000s of rounds of ammunition in Mazza's home, but no firearms recovered
He says Mazza wouldn't answer question(s) about the firearms. He says there were hunting knives and swords & that Mazza claimed to have the weapons, because he no longer had guns
Mazza is the latest in a growing number of military veterans charged in US Capitol attack. His defense lawyer says he was honorably discharged from US Army
Defense: "The President of the US .. lied to them that the election was stolen" No evidence was produced, he says
Defense says Mazza has a prior DUI and a "simple battery where the penalty was a fine"... "must not have been too serious"
He wants Mazza released home to Indiana, with prohibition from returning to DC (except for court)
Judge is going to reconvene this hearing *tomorrow* at 3pm.
For now, Mazza stays put in pretrial detention

NEW: Justice Dept recommends five months prison in the Jan 6 case of Jeffrey Register, who is accused of running past police & seeking to enter House Chamber on January 6, while wearing a "Gods, Guns and Trump" hoodie
He then allegedly "factory reset" phone & lied to FBI

Justice Dept: "Ashli Babbitt was shot and killed at the location to which Register had enthusiastically drawn the crowd"
ONE YEAR AGO: Accused OathKeeper Jan 6 conspirator got the "signal" she was waiting for .....
according to the feds
(quick thread)
According to feds, in Nov 2020, she'd texted "I am concerned this is an elaborate trap. Unless the POTUS himself activates us, it’s not legit. The POTUS has the right to activate units too. If Trump asks me to come, I will. Otherwise, I can’t trust it.”
But a year ago this week, defendant "perceived her desired signal," according to Justice Dept

to come,” & how, “If Trump activates the Insurrection Act, I’d hate to miss it”
NEW: In Xmas Eve court filing, feds seek pretrial jail for Jan 6 defendant Mark Mazza of IN, alleging he had *loaded gun* amid mob on & *dropped the gun* amid crowd. Feds say Mazza later falsely reported gun was stolen in Ohio and they say he had stolen DC Police baton in home
Prosecutors: "Mazza loaded his Taurus Revolver both with shotgun shells and cartridges containing hollow point bullets, which are bullets that expand on contact and are significantly more lethal than regular bullets" ... on Jan 6 in DC
Prosecutors (more): "Mazza admitted to taking the police baton on Jan 6.. and to using it to strike a law enforcement officer in the tunnel. Mazza further admitted that he was recently in possession of
several other firearms..."
