Edward Vallejo, charged in the same seditious conspiracy indictment as Oath Keepers leader Stewart Rhodes, has a federal detention hearing that is about to begin.

He allegedly discussed “armed conflict” and “guerilla war.”

Listening in, for @LawCrimeNews
Vallejo is represented by federal defender Debbie Jang.

U.S. Magistrate Judge Boyle presides.
AUSA:

"This is not an individual who was staying at home yelling at a television screen."

Instead, Vallejo is someone who brought an "arsenal" of weapons across the country.
AUSA quotes Vallejo saying this:

“The American people are going to be told today that we have liberty and justice for all, or they’re going to be told, ‘Fuck you.’ Okay? And if they’re told, ‘Fuck you,’ that’s going to be the declaration of a guerilla war."
The prosecutor said that Vallejo was part of the so-called quick reaction force, or QRF.

Feds included this photo that they say is of Vallejo (on the left) and fellow QRF team member (on the right), in their memo calling for his detention.
Vallejo "pledged fealty to his commander Stewart Rhodes," the prosecutor says.
AUSA: "The government acknowledges that the defendant is not a young man, but he is a dangerous man."

Vallejo is 63 years old.
AUSA quotes Vallejo's tweet: “There was NO INSURRECTION on J6 just a peaceful protest.”
His defense attorney Jang is up, speaking about his work with veteran's groups and Alcoholics Anonymous.

"He does not have a criminal history, and there is nothing in his past that indicates violence or violent behavior."
Jang claims that her client played a "minor role" in the alleged conspiracy.
AUSA says that Vallejo's threat of violence is ongoing:

"All the way through December, [...] he's posting on Twitter, violent goals."
"There is compelling evidence about your potential for danger," U.S. Magistrate Judge John Z. Boyle said.
Boyle quotes Vallejo's tweet cited in the government's memo last December.

“I HAVE NEWS FOR YOU … you will NEVER achieve ‘vaccine equality’ as long as I, and others like me, are alive! … I will DIE first, and that’s only when I run out of AMMUNITION!”
Judge Boyle on the QRF: "If Mr. Rhodes had given that order, you would have complied."

"Therefore, you are a serious danger at this time."

BREAKING:

Martin Shkreli must pay a $64.6 million fine and is BANNED FOR LIFE from "participating in the pharmaceutical industry in any capacity," a federal judge ruled.

DEVELOPING story, @LawCrimeNews. lawandcrime.com/high-profile/j…
The $64.4 million is disgorgement to the states.

I'm reviewing the 135-page (!) breaking ruling to see what, if any, other liability Shkreli may face as the result of today's decision.
That ruling is embedded in the story.

A hearing is scheduled to begin shortly in the case of @MaryLTrump v. Donald Trump.

Covering the proceedings virtually, @LawCrimeNews.
New York County Supreme Court Justice Robert R. Reed presides over oral arguments on the defendants' motion to dismiss.

The attorneys are:

John Quinn for Mary Trump

Gary Freidman for Maryanne Barry

James Kiley for Donald Trump
Up first, Freidman for Maryanne Barry

He says his two main arguments are that the claims are time-barred and covered by the terms of the broad release agreement.

Just in:

Ghislaine Maxwell WON'T face a separate perjury trial, if she loses her post-trial motions.

Feds say avoiding a separate trial on the false statement counts advances "victims' significant interests in bringing closure to this matter" and avoid trauma of more testimony.
Background:

Jurors only heard the first six of the eight counts of Maxwell's indictment.

The last two involved allegations that Maxwell lied on depositions in her civil litigation with Virginia Giuffre Roberts.

Those counts wouldn't have moved the needle on sentencing.
Maxwell had succeeded in severing the last two counts from her trial in a pre-trial motion.

This wrinkle was anticipated—and confirmed in a letter about scheduling for sentencing, which can be read here: documentcloud.org/documents/2117…

Travis McMichael, the gunman who murdered Ahmaud Arbery, sentenced to LIFE WITHOUT the possibility of parole.
Greg McMichael will be sentenced to life WITHOUT the possibility of parole as well.
Bryan WILL have the possibility of parole, as the judge said—unlike the McMichaels—he showed remorse.

Story imminently, @LawCrimeNews

Watch the sentencing proceedings for the three men convicted of murdering Ahmaud Arbery embedded in this preview story written by @LawCrimeNews' @AlbertoLuperon.

The hearing begins in five minutes. lawandcrime.com/live-trials/li…
The court appears to be running a little behind schedule.
Proceedings seem to be running at least 30 minutes behind now.

A reminder:

The counts of conviction carry a mandatory minimum of life for the men.

Judge Walmsley's primary decision will be whether they are eligible for parole.
