Edward Vallejo, charged in the same seditious conspiracy indictment as Oath Keepers leader Stewart Rhodes, has a federal detention hearing that is about to begin.
He allegedly discussed “armed conflict” and “guerilla war.”
Vallejo is represented by federal defender Debbie Jang.
U.S. Magistrate Judge Boyle presides.
AUSA:
"This is not an individual who was staying at home yelling at a television screen."
Instead, Vallejo is someone who brought an "arsenal" of weapons across the country.
AUSA quotes Vallejo saying this:
“The American people are going to be told today that we have liberty and justice for all, or they’re going to be told, ‘Fuck you.’ Okay? And if they’re told, ‘Fuck you,’ that’s going to be the declaration of a guerilla war."
The prosecutor said that Vallejo was part of the so-called quick reaction force, or QRF.
Feds included this photo that they say is of Vallejo (on the left) and fellow QRF team member (on the right), in their memo calling for his detention.
Vallejo "pledged fealty to his commander Stewart Rhodes," the prosecutor says.
AUSA: "The government acknowledges that the defendant is not a young man, but he is a dangerous man."
Vallejo is 63 years old.
AUSA quotes Vallejo's tweet: “There was NO INSURRECTION on J6 just a peaceful protest.”
His defense attorney Jang is up, speaking about his work with veteran's groups and Alcoholics Anonymous.
"He does not have a criminal history, and there is nothing in his past that indicates violence or violent behavior."
Jang claims that her client played a "minor role" in the alleged conspiracy.
AUSA says that Vallejo's threat of violence is ongoing:
"All the way through December, [...] he's posting on Twitter, violent goals."
"There is compelling evidence about your potential for danger," U.S. Magistrate Judge John Z. Boyle said.
Boyle quotes Vallejo's tweet cited in the government's memo last December.
“I HAVE NEWS FOR YOU … you will NEVER achieve ‘vaccine equality’ as long as I, and others like me, are alive! … I will DIE first, and that’s only when I run out of AMMUNITION!”
Judge Boyle on the QRF: "If Mr. Rhodes had given that order, you would have complied."
"Therefore, you are a serious danger at this time."

Jurors only heard the first six of the eight counts of Maxwell's indictment.
The last two involved allegations that Maxwell lied on depositions in her civil litigation with Virginia Giuffre Roberts.
Those counts wouldn't have moved the needle on sentencing.
Maxwell had succeeded in severing the last two counts from her trial in a pre-trial motion.

In a hearing scheduled to begin shortly, Trump's lawyers will try to dismiss a lawsuit accusing him, Rudy Giuliani, the Proud Boys and the Oath Keepers of violating the Ku Klux Klan Act in connection with the Jan. 6 attack on the U.S. Capitol.
As the hearing begins, Trump's lawyer Jesse Binnall claims that the complaints are "full of propaganda meant to achieve a political rather than a legal objective."
