Peter Vogel,a public interest solicitor,is running a case against the idea that it is compulsory for children to go to school in the pandemic and that parents will be fined it they do not comply.
His argument is that
3. the government cannot guarantee the children's safety as they are not yet vaccinated * 2.
He wants to run a court case for parents to have the right to choose when they send their children to school.
You might note that QLD has put the start of school back by a fortnight.

that many children will almost certainly contract the COVID-19 virus as a result. No child under 12 is 2*vaccinated at the moment, and the government itself admits COVID-19 will rip through schools.
NSW Health admits that 1.2% of children who contract Covid
6. need hospital treatment. As well there is “long COVID,” Medical experts are concerned about the long term effects on brain,heart, lungs & kidneys of young children.
Some parents might have no choice but to take this risk, others do. Last term, parents who defied the government
7. and kept their kids safe from COVID at home were threatened with legal action and fines.
PARENTS HAVE A RIGHT TO CHOOSE!!
I am the father of five girls, the youngest two being school students. I am also a solicitor.
I am now working with Covid Safe Schools Inc. to take this
8. case to the Supreme Court of NSW.

We simply want parents to have the choice to keep kids home if they assess the COVID risk to be unacceptable.

We want the court to say that forcing children to attend class during a pandemic is a breach of
the government’s “duty of care”
9.We have three plaintiffs ready to go to court.Two are mothers with compromised immunity and might die if they get COVID the third has no health issues and wishes to stay that way.
The problem we face is that the plaintiffs are fearful that if they lose,the NSW government
10. will make an example of them by pursuing them for costs. We plan to ask the court for “protective cost orders” limiting costs to $50,000.That means we need to raise at least this much before we go to court, or find a benefactor prepared to sign a guarantee for that amount.
11. This can be done anonymously if preferred.
I can’t afford to underwrite this, as I have a propensity for running public interest cases like this that don’t pay very well!
My view is that it is an extremely strong case and we are likely to win. Even if we lose, it would be a
12. very brave judge who would order a sick mum to pay the Department $50,000.
School starts on 28th Jan so this this is URGENT. I will be ready to start proceedings before then if we can solve the financial concern.
