AR reminds KF he is still under oath. AC states an 80 page document concerning AA, has landed on her desk during the lunch hour. She has not had time to go through the full document. AC regrets she needs time to take instructions and digest the disclosure that has arrived.
AR: let us hear from LJ
LJ: I've been clear that AC should have time and it's been a mistake at our end. It's the emails generated to committee members about the dates and about security. That's the nature of the disclosure. I've said we're very sorry this has happened.
LJ: I have to accept AC needs time for this. We're both still confident we can complete evidence tomorrow. It's a 79 page PDF and of course AC needs time. I'd not suggest anything other. She has suggested we adjourn now but maybe we can finish with KF first
LJ: we don't want to be anything but entirely fair with RRS and her team.(too fast) it has been complex, This is not an excuse, it should have been disclosed and we're very sorry about it.
AR isn't sure we can complete by the end of the week.
AC is confident it can be.
AR: Is it not possible to give KF an hour now to finish today? Is there is any merit in keeping you here?
AM instills tomorrow morning. The judge is aware he's throwing ideas out.
AM: the way the chronology flows I don't think it'd be fair for a witness to be put in this now.
LJ: We can use the time AC needs constructively. We are profoundly sorry about this
AM: my client has asked for clarity if she can publish her statement.
AR: well it's her document and she's finished giving evidence.
LJ: we will conclude our discussions about AA anonymity as well
AR: Rather unusually on day 4 of a 5 day proceedings I am being asked to stop proceedings because defence should have put in documents well before today. The claimant and her team need time to process this.
AR: I have yet to see the disclosure. Sounds like it has some relevance but u cannot for a moment expect the claimant and team to express a view until they've seen it.
AR: I'm told this case is complicated with much disclosure. I have done 15-20 day cases which are more document heavy and complicated...in a case where the defendant failed to take their case seriously...fairness must prevail.
AR: I am being told we are still on track by tomorrow and on Monday if however we run out of time and there needs to be further time, that will be very disruptive. If more costs arise the defendent will need to provide those costs.
AR: I expect tomorrow morning to have a simple bundle of additional documents. Two copies
LJ: Two things. I wanted to reflect that this is not the defendent not taking the case seriously. Second this I will need to furnish KP with the documents.
AR: Lastly I will say this, provision has already been made to preserve AA's identity. If it is discovered it will still be contempt of court. They cannot publish it at will. I will see you tomorrow morning at 10.30 and we hope not to have any more technical disasters.
