Hearing right now with Beryl Howell, chief judge of DC District Court. This is an unusual hearing bc it appears the defendant, Greg Rubenacker, will plead guilty to all 10 counts in his indictment.
This includes 5 counts related to charge that relied on Harris, Pence location

DOJ fixed the 1752 charges against Rubenacker in a superseding indictment filed in November.
But DOJ still refuses to specify Pence's location.

Howell is reading through the accusations against him, including smoking something in the Capitol and yelling at Capitol police officers "who are you guys serving, we are the people."

Defendant swung a water bottle allegedly at police who then sprayed him in the face. He couldn't see after that, so an officer helped him out.
"I hope you guys are proud of that, this is a communist act," he said in response to seeing cops punch protesters in the face.

It is clear during these hearings and filings that police behaved EGREGRIOUSLY on January 6. It's ok to punch Americans in the face in the Capitol building.

The chief judge has not confronted DOJ to explain its initial lies related to Harris' whereabouts in the building.

Rubenacker rejected offer to plead guilty to two counts including obstruction and assaulting police. However, his sentencing would be the same whether he pleaded guilty to 2 or 10 counts due to an enhancement in DOJs plea offer.
With this, he reserves right to appeal.
