NEW: The FBI obtained a recording of Traci Sunstrum’s phone call last night, per DOJ attorney.

They government suggests they vacate the plea and set the case for trial.
Traci Sunstrum’s lawyer tells the court that he believes Sunstrum is satisfied by his services and stands by her plea.

“I think we’re prepared to go forward today,” he says.
Traci Sunstrum is now under oath, and is being re-questioned by the judge.

Do you still stand by your plea?

Yes.

Did you plead guilty voluntarily and of your own free will?

"Yes, your honor, I did.”

Says she wasn’t forced to plead guilty.
Sentencing is moving forward.

DOJ is citing comments that Sunstrum made last night.

It’s the same group call where fellow Jan. 6 defendant Gina Bisignano made comments about regretting her own plea:

Defense lawyer maintains that Sunstrum has changed since Jan. 6.

Her call "was slightly taken out of context,” her lawyer says.

“I am firmly convinced that she stands by her plea,” he says, even though they have different views of what happened on Jan. 6.
Sunstrum is “scared” and does not want to go to jail even for 14 days, her lawyer says.

She’s been “put through the wringer” for the past year, and won’t “be on the front lines” if there’s another call to action, due to what’s happened to her.
Traci Sunstrum addresses the court, saying she has First Amendment rights.

“There is a proper way for me to peacefully assemble,” she says.
As he’s done before, Judge Christopher Cooper is talking to this Jan. 6 defendant about how she could have been shot like Ashli Babbitt.

“That could’ve been you, have you thought about that?”

“Do you know how many people died on Jan. 6?”

Because of the legal issues with a split sentence of imprisonment/probation on a petty offense, Judge Cooper imposes a sentence of 36 months of probation. The first 30 days will be on home detention.
Judge Cooper tells Sunstrum he hopes that she put “all of this nonsense” behind her.

“I fully expect that there will be no repeat of anything like that conduct,” Cooper said.

Annie Howell's lawyer, Heather Shaner, is asking for probation.

Howell, her lawyer writes, began "her journey to awareness shortly after the insurrection on January 6th," and met with the @January6thCmte.
