My name is Patrick.A father and a businessman. I run a business called Mandela Mattresses.

I am just one person.
It all began In June last year, I got 70% asset financing from my bank (cooperative bank of Kenya) to get a car. A van is really important for the business I do so that's why I chose to take that path.. (2/28)
Lets call this car KDC. I got the car on June 9th. It was comprehensively insured BY @First_Assurance
As I have stated, I am writing this because nimefika mwisho. I have gone to every office imaginable trying to get help on my case. The bank, the insurer, ntsa. (3/28)
Everywhere.
The 30% I deposited was hard earned money. All went well for 3 months.On 26th September, the car got stolen.
After accepting my loss, I chose to move on. I asked for financing for another car from the same bank.They agreed. (4/28)
I took all my business capital and put a deposit on another car. I was sure insurance would pay the claim for the stolen car in less than 3 months. I had been told that if it's a straight forward case, they'll definitely pay. It was a straight forward case. (5/28)
On 30th September 2021, first assurance sent someone to investigate the case. They were given 2 weeks to comeback with a report. From the first day we got in contact, that investigator started asking for a bribes. (6/28)

Let me state here that the police officer was very helpful and understanding, didn't ask for a bribe, get me advice on the way forward, (7/28)
And held my hand through those difficult first days. He's called officer kilundo from buruburu Police station. He and a few other policemen I met during this process showed there's hope in the police service. I will forever be grateful for what they did for me.

So, I didn't give the insurance investigator the bribe he needed. I know this is Kenya and you have to bribe to get services, but I was broke, I dint have a single cent. I also wasn't lying in my report, (9/28)
I had told the whole truth about the circumstances that led to the car being stolen. I think that's why the investigator took almost 2 months to hand over the report, instead of the 2 weeks recommended by the insurance company.

The insurance company said that the report was inconclusive. And ordered another investigator to investigate. This was in November 24th.
The second investigator was given a week. He was very professional. He actually took a week to investigate and handed in the report. (11/28)
I thank God for him too.
After the 2 investigations. First assurance agreed to pay the KDC theft claim.
They requested for a few documents including something they called a certificate of deregistration.
That was in December 17th 2021.

I took all the documents they requested to the bank. This is because they are also my insurance agent.
The problem now came in when someone at the bank sat on my case since December to end of January.
Keep in mind that when I asked for financing for the second car. (13/28)
The same bank agreed. We had a good relationship. My statements were good.
That was in November. I finally got the new car in December 23rd 2021. Just before Christmas.let's call it KDE.

I also knew that the insurance company would pay the claim in a few days or at most a week. That would be early January.
That was ok. My business wouldn't have been at a stand still for too long. I would get back on track.
Items had started to get out of stock. (15/28)
But I wasn't too worried. I had confidence in the process.
I had no clue that someone at my branch had sat on my file.
I kept following up with my insurance agent at the bank. It got to a point that they stopped picking my calls. (16/28)
They finally uploaded the file end of January.
About 3 weeks ago.My insurance agent told me that they had finally taken all the documents required to the insurer.
My account was one month over drawn because I was still paying for both cars. (17/28)
The stolen KDC and the new KDE. Every month.
But I was still not worried. Insurer takes around a week to pay if all documents are OK.
At this point of the story, we are in early February this year.
A few days after this, (18/28)
I get a call from my insurance agent at the bank that the insurer, first assurance, is insisting on getting a certificate of deregistration.
I thought the insurance agent had submitted it.
They(insurance agent from the bank) stated that they hadn't submitted that, (19/28)
.. they had submitted the original logbook instead.
They advised me to go pick up the logbook from the insurer, head to ntsa and deregister the car myself.
I did pick the log book but ntsa refused to deregister the car without the banks consent via a letter. (20/28)
Then started the back and forth. Mara my bank branch should write the letter to the ntsa. Mara the bank's head office.
Most of That was last week but one.
Last week on FRIDAY 25TH February 2022, I got a call from my bank that the new car (KDE) is being repossessed. (21/28)
I didn't understand. There was no prior notifice or warning. On Saturday, it got repossessed. They even hurt my sister who was driving the car at the moment of repossessing.
The bank says that they will advertise the car for auction on Friday. 2 days from now. (22/28)
None of this has been officially communicated.
I am very devastated.
My issue with this whole thing is:
1. Cooperative bank seems to intentionally frustrate the process of getting the certificate of deregistration. (23/28)
This certificate is all the insurer needs to pay the KDC theft claim
2. It has been 5 months now since my comprehensively insured car got stolen, and I am yet to get paid.
3. The circumstances under which the KDE got repossessed. Plus the bodily harm caused to my sister. (24/28)
4. My business is at a stand still because I put all my business capital in the deposit I needed to get the KDE van. That was around ksh. 500,000. And that's the reason I haven't paid the February installments. The business is suffering. (25/28)
