Durbin is up and asks KBJ about her judicial philosophy. @Hegemommy made a great point yesterday that her answer in her statement yesterday was not different from what John Roberts said about calling balls and strikes. But the Senators will treat her differently; I wonder why.
KBJ has 3 steps:

1. She clears the decks of any preconception.
2. She evaluates all the facts from all perspectives: all the parties and amici.
3. interpretation and application of the law to the facts in the case. This is where she understand the constraints on her authority.
She says adherence to text is a constraint on my authority. (This is textualism.)

She's trying to figure out what the words mean as intended by the people who wrote them.
- looking at original documents
-looking at original public meaning

She's not importing personal views!

Durbin asks about court packing and says that McConnell shrank the court to 8 people when he refused to let Garland have a hearing.

Durbin points out that ACB kept saying "I cannot opine on that. I can't opine on matters of policy."

Durbin brings up Hawley's nonsense about KBJ being soft on child pornographers.

Asks her how those accusations affect her personally. Asks what was going through her mind.

She says re Hawley's claims: Nothing could be further from the truth.
KBJ says she focuses on the children's voices and the victim's statements. She focuses on adult victims of child sex abuse who say they can never have a normal life because of the abuse.

It's absurd that she has to respond to these baseless charges from Hawley. He's gross.
She says the sentencing guidelines for people caught with child abuse sex materials were created before the internet. The sentencing was created to be based on volume—when people were getting photos in the mail.

Now there's so much on the internet, so sentences have to change.
This won't stop Hawley from playing to his Q base because he's shameless, but everyone should remember her answer here.
This makes sense. Basing sentencing on volume means nothing when someone can have gigabytes full of child sex abuse materials as opposed to having few pictures in an envelope. The volume doesn't correlate to the level of offense anymore—I think that's the point.
Now Durbin points out a certain Trump judge (Sarah Pitlyk (sp?)—she's on the 4th Circuit and is WOEFULLY unqualified—who sentenced a person to a sentence much lower than required by the guidelines for child sex abuse materials.

Good line of questioning here.
Now Durbin is asking her about her representation of Guantanamo detainees. Basically everyone deserves a defense. It's a lawyer's job.

He discusses that John Adams represented British soldiers involved in massacre of American soldiers.

So there, is Durbin's vibe.
KBJ: Federal public defenders don't get to pick their clients. It's a service. You are standing up for the constitutional value of representation.

I represented as an appellate defender of some of those detainees. This was an uncertain legal landscape.
Full disclosure: I did some Gitmo detainee work when I was a first year associate at Latham & Watkins 20 years ago.

EVERYONE DESERVES DUE PROCESS RIGHTS.

And she might not have done that had she not been a criminal defense lawyer.
People don't understand their constitutional rights unless they're educated about them. The right to due process is often classist, which is an argument @ElieNYC makes in his book and no he's not paying me to praise his book it's just a damn good book. lol
IF you don't know your rights, how can you assert them?

If the system makes it so that working class people have no hope of getting a good defense or asserting their rights, what good is the due process clause? It ends up working only for the wealthy who tend to be white.

A lot of private firms did habeas briefs for Gitmo detainees as pro bono work.

Ketanji Brown Jackson is the second woman to sit on the D.C. Circuit Court of Appeals and was nominated by Biden in 2021.

She formerly clerked for Justice Breyer and was a federal public defender.

She is seen as a frontrunner due to the D.C. Circuit Court to SCOTUS pipeline.

Privilege check: Did you know that the forced sterilization of disabled people is still occurring in the United States?

A new @nwlc report shines light on the dark reality of modern day eugenics.
“Forced sterilization laws are not an aberration—they are part of a larger, horrifying system that prevents disabled people from making basic decisions about their lives, their families, and their futures,” says Ma’ayan Anafi, author of the report.

🚨 31 states + DC have laws explicitly allowing the forced sterilization of disabled people (the most recent were passed in 2019 in Iowa and Nevada)
🚨 17 states allow forced sterilizations on disabled children (only 3 states explicitly prohibit this)
