As soon as Griswold v. Connecticut extended substantive due process to the 'right to choose' whether or not to use contraception, the GOP realized it had made a huge mistake by creating the precedent in Allegeyer & Lochner.
Lochner & Allegeyer were cases from the turn of the 20th century (early 1900s) that were about contract rights. A Republican majority Court opined that the Bill of Rights created an inherent 'right to choose' that emanated from the various aspects of protected individual rights.

Like the nearly 50 years since Roe, I know the GOP will inevitably spend the next 50 whittling down this right to prevent low-income women, servicemembers & millions more from having access to the care they need & the care the highest court in the land says they deserve.
That kind of discrimination is not right, not fair and it’s certainly not equal. It is time for Congress to pass the EACH Woman Act so that every woman in this country has equal access to her constitutionally-protected rights, no matter her income, her race or her zip code.

There is no medical procedure more regulated than abortion; there isn't even a close second.

Continuing to restrict abortion—laws which *only* affect women—is why conservatives will fight tooth and nail against allowing the Equal Rights Amendment into the Constitution.
Since Virginia ratified the ERA a few days ago, that should be it. The courts—which the constitutional amendment process is specifically designed to get around—should have no say in whether it's a valid amendment.

But have little doubt the Roberts Court will strike down the ERA.
