Pleased to speak to @bbcsoutheast about the experiences of my clients Sam & Jacob who were subjected to mechanical restraints at an autism specialist school.

Story here from 1:17

Mechanical restraint chairs used in this manner are inhumane, degrading & traumatic for children.

Kent County Council admitted it failed to consider less restrictive options than #restraint.

The boys received an apology & £40,000 damages each for false imprisonment and pain and suffering.

@LeighDay_Law
@LeighDay_Law In my view, these kind of restraints are not compatible with articles 3, 5 & 8 ECHR - that's what we argued in the legal case.
Restraints are still being used against children with #SEND up & down the UK. See the 2019 ^ 2020 reports from @CBFdn & @Pabss which surveyed families affected

This is a pressing human rights issue. The DfE @educationgovuk needs to take urgent action to reduce the use of restraint against #autistic & learning disabled children.

@theRRNetwork
Also thanks to the indomitable @TorButlerCole for acting as Counsel
And also, a plug for the #HumanRightsAct under which we could argue inhumane & degrading treatment, deprivation of liberty & failures to investigate.

And the Legal Aid Agency which funds cases like this.

A short thread 🧵 about Samuel & Jacob's case, and the use of #restraint against children with autism, learning disabilities or #SEND.

The parents Annie & Mark aren't on Twitter but want to raise as much awareness as possible.

1. We brought a civil & #HumanRightsAct case against Kent County Council for the use of mechanical restraint chairs against Samuel & Jacob while they were at a specialist primary school for autistic children, Five Acre Woods School.
2. Sam & Jacob were active, sensory seeking children who loved climbing, running around & being outside. They were non-verbal & struggled to communicate. Here they are out walking with their dad, Mark, at the time they attended the school (all photos used with permission). Image

The consultation by @MoJGovUK on 'Delivering Justice for Victims' closes today (thread 🧵) :

@CBFdn @mencap_charity @AQuinnUnbroken
This is an opportunity to reflect on the dismal position faced by learning disabled and / or autistic people who are victims of crime & abuse. Far too often, there is no justice in the criminal justice system for them.
1. There is no mandatory guidance from the National Police Chiefs Council @PoliceChiefs for the investigation of crimes against learning disabled / autistic people, or people with additional communication needs.
