My opinion of Roe v. Wade was formed during law school. I remember reading the Yale constitutional law scholar and abortion rights supporter John Ely who wrote, “Roe v. Wade is bad constitutional law because it’s not constitutional law and doesn’t pretend to be!”
Whether you agree with Roe’s outcome or disagree, Roe was judicial usurpation at its worst! It was the Supreme Court acting as a national legislature and not as the supreme arbiter of the meaning of the Constitution! There’s not a word in the Constitution about abortion!
Roe injected abortion into every Presidential race from 1980 on! Roe has distorted national politics for 2 generations! With the overturning of Roe, abortion will become a matter of state policy which it always was and always should have been!
My hope for followers of Jesus is that we would be pro-life and not just pro-birth. In other words, that we would come alongside of mom AND baby post-birth with a strong social safety net to care for struggling families! Pro-life must come to mean thriving, flourishing life!
But none of this will be solved by legislation alone! Until our society becomes convinced of the inherent dignity of every human life, people will continue to abort unwanted children. Human value is not something determined by whether someone is “wanted”! Value is given by God!
