My opinion of Roe v. Wade was formed during law school. I remember reading the Yale constitutional law scholar and abortion rights supporter John Ely who wrote, “Roe v. Wade is bad constitutional law because it’s not constitutional law and doesn’t pretend to be!” Whether you agree with Roe’s outcome or disagree, Roe was judicial usurpation at its worst! It was the Supreme Court acting as a national legislature and not as the supreme arbiter of the meaning of the Constitution! There’s not a word in the Constitution about abortion!
