7/ On this instruction, government has better argument as Sussmann's proposed instruction would confuse jury.
8/ As I expected, "materiality" is the fight. Sussmann is trying to relitigate the issue court already rejected that "capable of influencing decision to initiate an investigation." He's losing on that but may be setting up the issue for appeal (he'll lose there too.)

13/ Interesting that Sussmann doesn't have many footnotes to describe this propose instruction. Court might give first paragraph as really that just elaboration on intentional, but the rest of it...not likely.
14/Sussmann wants his theory of defense provided to jury, subject to change based on the evidence, but basically lays out what he's going to argue:
15/ So, in sum, the biggest fight is over materality, which Sussmann will lose in large part IMNSHO. Govt' likely won't get the first instruction as much of it is included later, but court might allow some of the detail to be added to later instruction. For most part,

THREAD: Reviewing Court's order in Sussmann case. LOL at this. In other words, Sussmann will likely not challenge Baker's statements before the jury b/c the text would make the argument unbelievable!
2/ Interesting: Court noting that given DOJ can't question Joffe on propriety of collecting Alfa Bank data, then maybe Joffe will be willing to testify anyway. I doubt it.
3/3 Overall, some in and some out, but rulings don't hurt gov't case at all and make Sussmann's defense harder.

3/ So now we need to move on from "dishonest" to "dishonest idiots." The "domestic supply of infants" was a direct QUOTE of a CDC paper authored by Jo Jones.

2/ Sussmann wants to admit a ton of emails showing he worked for Clinton campaign and DNC. Durham objects re DNC saying irrelevant and to both saying cumulative and waste of time, but agrees limited allowed to show he was well-respected by FBI & concerned re cyber issues and
3/ to allow Sussmann to argue he was billing for work related to his cyber-security stuff. He will likely also try to argue not material b/c they knew he was working for Clinton campaign.
