As we mark #TitleIXAt50 today, here are six #TitleIX changes ED is proposing to ensure federally funded education programs & activities are free from ALL forms of sex discrimination: [🧵⬇️] U.S. Department of Education Title IX Proposed Regulations
1. #TitleIX protection from all forms of sex discrimination, including discrimination based on:
- Sex stereotypes
- Sex characteristics
- Pregnancy or related conditions
- Sexual orientation
- Gender identity
2. Strengthening protections for LGBTQI+ students by clarifying that Title IX’s protections against discrimination based on sex apply to discrimination based on sexual orientation and gender identity.
As SCOTUS wrote in Bostock v. Clayton County, it is “impossible to discriminate against a person” on the basis of sexual orientation or gender identity without “discriminating against that individual based on sex.” #TitleIX
3. Protecting the right of parents & guardians to act on behalf of & support their elementary & secondary school children.
4. Protecting students and employees who are pregnant or have pregnancy-related conditions. Today, far too many women still see their education derailed because of pregnancy discrimination.
5. Requiring schools to:
- Respond promptly to sex discrimination complaints with a fair & reliable process
- Support students & employees facing sex discrimination
- Clearly & effectively communicate nondiscrimination policies
6. Clarifying & confirming protection from retaliation for students, employees, & others who exercise their #TitleIX rights.
ED will also engage in a separate rulemaking in the future to address #TitleIX’s application to athletics.
